City Council <br />Study Session Summary <br />May 10, 2011 <br />Page 3of 6 <br />and the BOA members present supportedsuch action.Board member, James <br />Stuart,stated that he thinks the process works. <br />Council Member Sackett relayed his experience on the Board of Adjustment in <br />using common sense when reviewing cases. <br />Gavin McMillan, staff liaison to the Board, stated the current BOA members do <br />an excellent job and they apply common sense in using the six criteria. <br />Troy Russ, Planning Director, said he has faith in the volunteers and <br />acknowledged their good work. Troy also supported a review by the City <br />Attorney and possibly a comparison study of other cities and what they use for <br />their criteria. <br />In conclusion, Mayor Sisk stated that he wants the BOA members to feel <br />comfortable with the legality of their actions and advised that the City Attorney <br />review the six criteria, but felt the review of other cities criteria was not a priority <br />at this time. <br />Update/Discussion –Building Code Board of Appeals (BCBOA) <br />The Building Code Board of Appeals is a six-member quasi-judicialtechnical <br />board that hears and decides disputed building code interpretations made by the <br />Chief Building Official. The BCBOA also serves as an advisory board to the <br />Chief Building Official and the Building Safety Division.Members present were <br />Robert Van Pelt, Chair, Peter Geise, Vice-Chair, David Rounds, Member and <br />Bart Wear, Associate Member. Matthew Berry and Gary Mancuso, also <br />members, were not present for tonight’s meeting. In 2010, the Advisory Board <br />workedon Green Building Code, BCBOA Bylaws and Residential Fire Sprinklers, <br />Code amendments and aMobile Home Ordinance. The Board’s 2011 goals are <br />to focus on Green building and Residential Fire Sprinklers. <br />Council Member Dalton asked if it was true in the State of Colorado that <br />plumbers are not allowed to install residential fire sprinklers.Chief Building <br />Official Jones confirmed that it’s true, however, he doesn’t support this <br />personally. Council member Dalton also is not in support of making a <br />homeowner spend more money to comply with green building codes. <br />Mayor Sisk asked the Board to look at residential fire sprinklers in a balanced <br />way. <br />Council member Muckle agreed with what the Board is presently doing with <br />reviewing residential fire sprinklers and asked the Board to keep the Council <br />updated. <br /> <br />
