20.0 EQUAL OPPORTUNITY EMPLOYER <br /> 20.1 Contractor will not discriminate against any employee or applicant for employment because <br /> of age 40 and over, race, sex, color, religion, national origin, disability, genetic information, <br /> sexual orientation, veteran status, or any other applicable status protected by state or local <br /> law. Contractor will take affirmative action to ensure that applicants are employed and that <br /> employees are treated during employment without regard to any status set forth in the <br /> preceding sentence. Such action shall include but not be limited to the following: <br /> employment, upgrading, demotion or transfer, recruitment or recruitment advertising, layoff <br /> or termination; rates of pay or other forms of compensation; and selection for training, <br /> including apprenticeship. Contractor agrees to post in conspicuous places, available to <br /> employees and applicants for employment, notice to be provided by an agency of the federal <br /> government, setting forth the provisions of the Equal Opportunity Laws. <br /> 20.2 Contractor shall be in compliance with the applicable provisions of the American with <br /> Disabilities Act as enacted and from time to time amended and any other applicable federal, <br /> state, or local laws and regulations. A signed, written certificate stating compliance with the <br /> Americans with Disabilities Act may be requested at any time during the life of this <br /> Agreement or any renewal thereof, <br /> 21.0 DISADVANTAGED BUSINESS ENTERPRISE (DBE) <br /> The Contractor (also referred to as "consultant" or "Consultant" for purposes of this Section 21) <br /> shall comply with the Disadvantaged Business Enterprise (DBE) requirements of this Section 21. <br /> 21.1 The Colorado Department of Transportation's 2001 Disparity Study found that all <br /> Disadvantaged Business Enterprises were underutilized on Colorado Department of Transportation <br /> (CDOT) construction contracts and on CDOT consultant contracts, i.e., it determined that all <br /> Disadvantaged Business Enterprises (DBEs) will be considered to be Underutilized Disadvantaged <br /> Business Enterprises (UDBEs). Since all CDOT DBEs are considered to be UDBEs, CDOT's DBE <br /> list will also be the UDBE list. <br /> 21.2 The Colorado Department of Transportation has determined the contract goal for DBE <br /> participation in this Contract will be met with certified DBE's who have been determined to be <br /> underutilized on professional services contracts. The DBE goal for this project has been established <br /> as follows: 5% <br /> 21.3. Definitions and Procedures For this project, the following terms are defined: <br /> A. Disadvantaged Business Enterprise (DBE). A small business concern that is <br /> certified as being: <br /> 1. At least 51% owned by one or more socially and economically disadvantaged <br /> individuals or, in the case of any publicly owned business, at least 51% of the stock of which is <br /> owned by one or more socially and economically disadvantaged individuals; and <br /> 8 <br />
