City Council <br /> Meeting Minutes <br /> March 15, 2011 <br /> Page 10 of 12 <br /> Wayne McCreesh, representing ConocoPhillips, confirmed due to the scale of the <br /> project, the one year extension will provide the applicant sufficient time to complete <br /> internal reviews and submit the final development plans for approval. <br /> Mayor Sisk inquired about the ownership of the properties. Mr. McCreesh noted the <br /> ownership of the properties has not changed. <br /> Mayor Sisk requested public comment. There were no public comments. <br /> MOTION: Councilor Dalton moved to approve Resolution No. 16, Series 2011, <br /> seconded by Mayor Sisk. All were in favor. Absent: Councilor Sackett. <br /> EXECUTIVE SESSION REAL PROPERTY ACQUISITION <br /> (Louisville Charter, Section 5 -2(c) Authorized Topics Consideration of real <br /> property acquisitions, only with respect to appraisals and other value estimates <br /> and strategy, and C.R.S. 24- 6- 402(4)(a)) <br /> REGULAR BUSINESS ITEMS SUSPENDED <br /> City Attorney Light explained the City Manager has requested an executive session for <br /> the purpose of considering real property acquisitions potential purchase of land, but <br /> only with respect to appraisals and other value estimates and strategy. <br /> City Clerk Varra read the statement from Section 2.90.050 of the Louisville Municipal <br /> Code, which outlines the topics eligible for discussion during an executive session. <br /> City Attorney Light explained the executive session is for the purpose of considering <br /> real property acquisitions potential purchase of land. He cited the Statement of <br /> Authority for convening an executive session as follows: Louisville Charter, Section 5- <br /> 2(3) Authorized Topics Consideration of real property acquisitions and the Colorado <br /> Open Meeting Law, Section .R,S. 24 -6- 402(4) (a). <br /> Councilor Dalton recused himself from the executive session due to a possible conflict <br /> of interest associated with this potential acquisition. He asked if Council makes a <br /> decision on the strategy on the property's acquisition, an announcement of the decision <br /> be made, so he may be free to talk about it at a later date. <br /> MOTION: Mayor Sisk moved the City Council convene an executive session to discuss <br /> and consider real property acquisitions, but only with respect to appraisals and other <br /> value estimates and strategy. He requested the executive session include the City <br /> Council, City Attorney Light, City Manager Fleming, Deputy City Manager Balser and <br /> Parks and Recreation Director Stevens. Councilor Clabots seconded the motion. All <br /> were in favor. Absent: Councilor Sackett. Councilor Dalton was recused from the <br /> executive session and left the meeting. <br />
