pertaining to deliveries, restrictions on signage, and standards that facility owners and <br /> employees must satisfy; and <br /> WHEREAS, the Louisville Planning Commission, after notice by publication and a <br /> public hearing, has recommended the City Council approve the amendments to Title 17 of <br /> the Louisville Municipal Code set forth in this ordinance; and <br /> WHEREAS, by adoption of this ordinance, the City Council does not intend to <br /> authorize or make legal any act that is not permitted under federal or state law but rather <br /> to establish local regulations governing the location and use of land for medical marijuana <br /> businesses; and <br /> WHEREAS, City Council has provided notice of a public hearing on said ordinance <br /> by publication as provided by law and held a public hearing as provided in said notice; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> LOUISVILLE, COLORADO: <br /> Section 1. Section 17.08.321 of the Louisville Municipal Code is hereby <br /> repealed in its entirety. <br /> Section 2. Chapter 17.08 of the Louisville Municipal Code is hereby amended <br /> by the addition of new Sections 17.08.263, 17.08.321, 17.08.356 and 17.08.367, to read <br /> as follows: <br /> Sec. 17.08.263. Location. <br /> Location means a particular parcel of land that may be identified by an address or <br /> other descriptive means. <br /> Sec. 17.08.321.A.(1) Medical marijuana business. <br /> Medical marijuana business means any person acting alone or in concert with <br /> another person, whether for profit or not for profit, who cultivates, grows, <br /> harvests, processes, packages, transports, displays, sells, dispenses or otherwise <br /> distributes the stalks, stems, roots, seeds, leaves, buds or flowers of the plant <br /> (genus) cannabis, or any mixture or preparation thereof, for medical use as <br /> authorized by Article XVIII, Section 14 of the Colorado Constitution. <br /> Sec. 17.08.321.A.(2) Medical marijuana center. <br /> Medical marijuana center means a person licensed pursuant to this code to <br /> operate a business as described in C.R.S. 12- 43.3 -402 and chapter 5.10 of this <br /> code that sells medical marijuana to registered patients or primary caregivers as <br /> defined in Article XVIII, Section 14 of the Colorado Constitution, but is not a <br /> primary caregiver. <br /> Ordinance No. 1591, Series 2011 <br /> Page 2 of 6 <br />
