5. within the Agriicultural (A), Open Space (OS) Administrative Office (AO), <br /> Business Office (BO), Administrative Office Transitional (AO -T), Industrial (I), <br /> Planned Community Zone District (PCZD), Mixed Use (MU -R), Commercial <br /> Neighborhood (CN), or Commercial Community (CC) zone districts. <br /> C. No licensed premises for a medical marijuana center or medical marijuana <br /> infused product manufacturer shall, at the time it is established and first <br /> licensed by the city, be located in a physical space exceeding eighteen hundred <br /> (1,800) square feet of leasable floor space, nor shall such a licensed premises <br /> ever exceed eighteen hundred (1,800) square feet of leasable floor space. <br /> D. No medical marijuana center or medical marijuana- infused product <br /> manufacturer shall operate as an outdoor or transient retailer, vendor or <br /> peddler. <br /> E. The distances described in subsections B and C above shall be computed by <br /> direct measurement in a straight line from the nearest property line of the <br /> land used for the purposes stated in subsections B and C above to the nearest <br /> portion of the building or unit in which the medical marijuana center or <br /> medical marijuana infused product manufacturer is located. <br /> Section 6. The restriction set forth in Section 17.16.235.B.1 as herein adopted <br /> shall not apply to an "existing medical marijuana business" as defined in Section 4 of <br /> Ordinance No. 1590, Series 2011, nor to a new license application upon sale of such a <br /> business; however, such business shall be subject to all other provisions and <br /> requirements of the Louisville Municipal Code, including without limitation those enacted <br /> by this ordinance and Ordinance No. 1590, Series 2011, and further, such restriction shall <br /> apply in the case of discontinuance or destruction as provided Chapter 17.36 of said <br /> Code. <br /> Section 7. Any person who violates any provision of this ordinance shall be <br /> punished by a fine of not more than $1,000 or by imprisonment not to exceed one year, or <br /> by both such fine and imprisonment. Each day during any portion of which any violation of <br /> any provision of this ordinance is committed, continued, or permitted by any such person <br /> shall be a separate offense. <br /> Section 8. If any portion of this ordinance is held to be invalid for any reason <br /> such decisions shall not affect the validity of the remaining portions of this ordinance The <br /> City Council hereby declares that it would have passed this ordinance and each part <br /> hereof irrespective of the fact that anyone part be declared invalid <br /> Section 9. The repeal or modification of any portion of the Louisville <br /> Municipal Code by this ordinance shall not release, extinguish, alter, modify, or change, in <br /> Ordinance No. 1591, Series 2011 <br /> Page 5 of 6 <br />
