ORDINANCE NO. 749 AN ORDINANCE MlENDING CHAP'I'ER 14.16 OF THE LOUISVILLE MUNICIPAL CODE BY REQUIRING APPROVAL TO SEHVE ALCOHOLIC BEVERAGES WHEN AN EXCLUSIVE USE PERMIT IS OBTAINED FOR USE OF THE CITY'S PARKS AND RECREATION FACILITIES. WHEREAS, there has been a number of problems concerning the use of alcoholic beverages at the City's parks and recreation facilities; and, WHEREAS, the Director of Community Services has requested that specific approval be required to serve alcoholic beverages if an exclusive use permit has been obtained for use of the City's recreation facilities; and, \VHE REAS , the City Council has determined that specific approval be required. NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLOR1\DO: Section 1. The following section is hereby added to Title 14, Chapter 14.16 of the Louisville Municipal Code: 14.16.110 Alcoholic Beverage Use It shall be unlawful for a person who has obtained an exclusive use permit under this chapter to use, distribute, or consume any alcoholic beverage or 3.2 beer during the exclusive use of the park and recreation facilities without having first obtained approval as part of obtaining the exclusive use permit. In order to obtain said approval, the following is required: L Application mus't be made to the Department of Community Services on application forms provided by the Department. 2. A deposit of $510.00 for a Louisville resident or $100.00 for a non-resident must be paid to the Department of Community Services. Said deposit will be refunded to the applicant after use of the park is completed and the facilities are inspected for damage. In the event damage to the City facilities does occur, the deposit may be used by the Department in repairing said damage. 3. Said approval will not allow the sale of alcoholic beverages but only allow parties to use and consume the alcoholic beverages on City property.
