<br />RESOLUTION NO. 27 <br />SERIES 2004 <br /> <br />A RESOLUTION RECOMMENDING APPROVAL OF AN AMENDMENT <br />TO THE HOME DEPOT FINAL PUD PLAN TO ALLOW FOR THE <br />CONSTRUCTION OF AN TOOL RENTAL CENTER ADDITION AND <br />OTHER SITE MODIFICATIONS RELATING TO OUTDOOR LOADING, <br />OUTDOOR SALES AREAS AND OUTDOOR STORAGE <br /> <br />WHEREAS, there has been submitted to the Louisville City Council a request to amend <br />Home Depot Final PUD - to allow for the construction of a Tool Rental Center addition to <br />the existing store fayade and request to review site modifications relating to outdoor loading, <br />outdoor sales areas and outdoor storage; <br /> <br />WHEREAS, City Staff and the Planning Commission has reviewed the information <br />submitted and found it to comply with Louisville Municipal Code Chapter 17.28 and the <br />Commercial Development Design Standards and Guidelines as reviewed in the Staff Report <br />dated 13 April 2004 and 22 April 2004; and, <br /> <br />WHEREAS, after a duly noticed public hearing on 13 April 2004 and 22 April 2004, <br />where evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission Staff Report dated 13 April 2004 and 22 April 2004, City <br />Council finds that request to amend the Home Depot Final PUD should be approved with the <br />following conditions: <br /> <br />1. Due to the length of time requested for the outdoor seasonal sales, (March - August each <br />year), the proposed outdoor seasonal sales and special events area locations shall be <br />ensured by an administrative review and approval by the Planning Director each year and <br />shall be applied for by the applicant to receive permission for the location and use of <br />these areas; <br />2. One "Tool Rental Center" identification sign, east elevation - 50 SF in size (2'x25') shall <br />be permitted and added to the new total sign square footage permitted for the Home <br />Depot PUD, allowing 448 square feet of signage to be allocated for the site; <br />3. The PUD shall be amended to reflect decorative concrete planter boxes be installed in a <br />"semi-circle" in front of the primary ingress and egress doors located on the east fayade of <br />the Tool Rental Center, (assisting customers in warning them of the impending traffic <br />lanes ahead); <br />4. The PUD shall be amended to reflect the plan for striping of the fire lane / street in front <br />of the primary ingress and egress door that will extend into the parking lot (alerting <br />pedestrians and vehicle traffic that customers may be traveling out of the Tool Rental <br />Center and into the traffic lanes); <br />5. "No Parking Signs" shall be posted on the fayade of the Tool Rental Center to advise <br />customers against potential parking violations if / when parking in front of the Tool <br />Rental Center; <br />6. The PUD shall be amended to reflect detailed plans to screen the wood storage racks for <br />
