<br /> RESOLUTION NO. 53 <br /> SERIES 2005 <br />A RESOLUTION APPROVING AN AMENDMENT TO THE CENTENNIAL VALLEY <br />GENERAL DEVELOPMENT PLAN AND AUTHORIZING THE MAYOR TO <br /> EXECUTE A 7TH AMENDMENT TO THE AMENDED AND RESTATED <br /> DEVELOPMENT AGREEMENT FOR CENTENNIAL VALLEY <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of an amendment to the Centennial Valley General Development Plan, including a <br />proposed 7th Amendment to the Amended and Restated Development Agreement, in order to <br />authorize a change in land use for property located at 410 Centennial Parkway and designated <br />Parcel G 1 on the proposed general development plan; and, <br /> WHEREAS, all materials related to the amendment to the General Development Plan <br />and associated agreements have been reviewed by City Staff, the Planning Commission and City <br />Council; and, <br /> WHEREAS, after a duly noticed public hearing on November 10, 2005, where evidence <br />and testimony were entered into the record, including the findings in the Louisville Planning <br />Commission Staff Report of November 10, 2005; and, <br /> WHEREAS, the Planning Commission was unable to reach consensus and a motion to <br />approve a resolution recommending conditional approval of the request failed (2-3); and, <br /> WHEREAS, City Council has reviewed the application and the City Council finds that <br />said application complies with applicable requirements of Chapter 17 of the Louisville Municipal <br />Code; and <br /> WHEREAS, City Council further finds that said application complies with the <br />recommendations of the 2005 Citywide Comprehensive Plan and has determined that the <br />application should be approved, with the following conditions: <br />1. At the time of a proposed change in use from the existing office use, the applicant shall <br /> submit a detailed site access plan. Said plan shall be subject to Public Works <br /> Department review and approval and may require the relocation of site access points <br /> and modifications to existing public street improvements, or other site modifications as <br /> determined necessary to preserve public safety. <br /> NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of <br />Louisville, Colorado does hereby approve an amendment to the General Development Plan and a <br />ih Amendment to the Amended and Restated Development Agreement for Centennial Valley, <br />subject to the above conditions. <br /> 1 <br />
