<br />RESOLUTION NO. 30 <br />SERIES 2004 <br /> <br />A RESOLUTION AMENDING THE CITY'S SCHEDULE OF WATER RATES AND <br />CHARGES WITH RESPECT TO SEPARATE IRRIGATION TAPS USED FOR <br />IRRIGATION OF PRIVATE LANDSCAPE AREAS IN DETACHED, SINGLE-FAMILY <br />RESIDENTIAL DEVELOPMENTS <br /> <br />WHEREAS, pursuant to the City Charter and the Louisville Municipal Code, the City <br />Council is authorized to fix, establish, maintain and provide for the collection of rates, fees, and <br />charges for water and other utility services furnished by the City; and <br /> <br />WHEREAS, the City Council has by resolution established the various rates and charges <br />for City water usage; and <br /> <br />WHEREAS, the City Council desires to amend its schedule of water rates and charges to <br />authorize an annual adjustment of the charges paid for water from separate irrigation taps used for <br />irrigation of private landscape areas in detached, single-family residential developments. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />1. Appendix A of Resolution No. 53, Series 2003, IS hereby amended by the <br />additional of the following provision at the end of such Appendix: <br /> <br />The City Manager, on an annual basis commencing with and for the year <br />2003 and thereafter, may authorize a credit for water rates charged to separate <br />irrigation taps used for irrigation of private landscape areas in detached, single- <br />family residential developments. Such a credit may be authorized in order to reflect <br />distribution of the costs of water from such separate irrigation taps as though the <br />water from such taps were distributed to the residential taps of the units within the <br />development. The calculation of any credit shall be made pursuant to the <br />methodology set forth in Exhibit A, attached hereto and incorporated herein. If the <br />City Manager determines that a credit is warranted based on such methodology, then <br />a credit shall be authorized and made against future water bills for the separate <br />irrigation taps, over such period of time, not to exceed one year, as is determined by <br />the City Manager. All determinations of the City Manager pursuant to this <br />paragraph shall be fmal. Nothing herein shall be construed to require the granting of <br />any credit, and the City Council at any time may determine to adjust any portion of <br />the foregoing credit program, or to cancel such program in its entirety, without <br />liability of any kind. <br /> <br />PASSED AND ADOPTED this 15th day of June, 2004. <br /> <br />1 <br />
