<br />RESOLUTION NO. 34 <br />SERIES 2004 <br /> <br />A RESOLUTION APPROVING A PURCHASE CONTRACT TO BUY <br />AND SELL VACANT REAL ESTATE FOR PARK, RIGHT-OF-WAY AND OTHER <br />GOVERNMENTAL PURPOSES, AND AUTHORIZING THE PAYMENT OF CITY <br />MONEYS FOR SUCH PURCHASE <br /> <br />WHEREAS, the City of Louisville desires to acquire approximately 4.0 acres of property <br />owned by Warembourg Colorado Ranches, LLC, such property to be for potential park, right-of-way <br />and other governmental purposes, including but not limited to construction of trails and Community <br />Park amenities and facilities; and <br /> <br />WHEREAS, the property lies in the NE Yi of the NE Yi of Section 17, Township 1 South, <br />Range 69 West of the 6th P.M., between Roosevelt Avenue and South 96th Street, and immediately <br />south of the "Community Park" property currently owned by the City of Louisville, and the property <br />is more particularly described in the Purchase Contract accompanying this Resolution (the <br />"Property"); and <br /> <br />WHEREAS, the owner of the Property has stated its desire to sell the Property to Louisville <br />upon the terms and conditions of a mutually-agreeable purchase contract; and <br /> <br />WHEREAS, a Purchase Contract has been proposed with the owners for purchase of the <br />Property. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />1. The proposed Purchase Contract to Buy and Sell Real Estate between the City and <br />Warembourg Colorado Ranches, LLC is hereby approved in essentially the same form as the copy of <br />such Purchase Contract accompanying this Resolution. <br /> <br />2. The Mayor is authorized to execute the Purchase Contract, except that the Mayor is <br />hereby granted the authority to negotiate and approve such revisions to said Contract as the Mayor <br />determines are necessary or desirable for the protection of the City, so long as the essential terms and <br />conditions of the Contract are not altered. <br /> <br />3. The Mayor, City Manager and City Staff are further authorized to do all things <br />necessary on behalf of the City to perform the obligations of the City under the Purchase Contract, <br />and are further authorized to execute and deliver any and all documents necessary to effect the <br />purchase ofthe Property under the terms and conditions of said Purchase Contract. <br /> <br />4. Unless other funds become available for use by the City as determined by the City <br />Council, moneys from the City Conservation Trust Fund - Land Acquisition shall be used to pay at <br /> <br />1 <br />
