<br /> Addendum C. The North 25' of the East 527.10' of the <br />Southwest Quarter of said Section 18 (R.O.W. Delany Rd.). <br /> Addendum D. The North 30' of Section 19 except the <br />West 1300' and the East l540.97' thereof (R.O.W. Dillon Road). <br /> Addendum E. The East 25' of the Southeast Quarter of <br />said Section 13 lying between the North R.O.W. Line of Dyer Road <br />extended, and the North R.O.W. Line of State Highway No. 36 known <br />as the Boulder Turnpike (R.O.W. South 80th Street). <br /> Addendum F. The West 30' of the Southwest Quarter of <br />the Northwest Quarter and the Southwest Quarter of the Northwest <br />Quarter of the Northwest Quarter of said Section l8, and the <br />South 25' of the Southwest Quarter of the Northwest Quarter of <br />said Section l8 (R.O.W. South 80th Street and Delany Road). <br /> SAID above described addenda contain 7.61 acres, more or less. <br /> Section 2. That said territory is hereby annexed to the <br />City of Louisville and included within the corporate boundaries <br />thereof as an integral part of said City. <br /> Section 3. The City Council finds this Ordinance is <br />necessary for the immediate preservation of the public peace, <br />health and safety and that an emergency exists because of the <br />following reasons: <br /> 1. Immediate dedication of valuable water rights and <br />storage facilities in quantites exceeding any other appropriation, <br />purchase or dedication in the City's history shall occur with this <br />annexation with said water rights being vital to the City's <br />continued development of it's water system. Said water rights <br />and facilities may not otherwise be available to the City in the <br />future even if adequate funding were available. Therefore, in <br />order that such dedication be started and completed as soon as <br />possible so that the citizens of the City of Louisville may <br />receive the benefit of the increased public health, safety and <br />welfare at the earliest reasonable time, it is the opinion of <br />City Council that an emergency exists and that immediate effect <br />of this Ordinance is necessary for the preservation of the public <br />peace, health and property. <br /> 2. Open space dedications, urban shaping and buffering <br />which will be the result of this annexation will be greater than <br />that which would be experienced by small, piecemeal annexations, <br />as is evidenced by dedication of 38% of the land area for open <br />space, as opposed to the l2% required by the City Subdivision <br />Regulations. ThereforE, in order that such open space dedications <br />occur as soon as reasonable possible so that the citizens of the <br />City of Louisville may receive the benefit of the increased public <br />health, safety and welfare, at the earliest reasonable time, it <br />is the opinion of the City Council that an emergency exists and <br />that in~ediate effect of this Ordinance is necessary for the <br />preservation of the public peace, health and property. <br /> -3- <br />
