<br /> . - <br /> I . Immediate dedication of valuable water rights and <br />storage facilities in quantites exceeding any other appropriation, <br />purchase or dedication in the City's history shall occur with this <br />annexation with said water rights being vital to the City's <br />continued development of it's water system. Said water rights <br />and facilities may not otherwise be available to the City in the <br />future even if adequate funding were available. Therefore, in <br />order that such dedication be started and completed as soon as <br />possible so that the citizens of the City of Louisville may <br />receive the benefit of the increased public health, safety and <br />welfare at the earliest reasonable time, it is the opinion of <br />City Council that an emergency exists and that immediate effect <br />of this Ordinance is necessary for the preservation of the pUblic <br />peace, health and property. <br /> 2. Open space dedications, urban shaping and buffering <br />which will be the result of this annexation will be greater than <br />that which would be experienced by small, piecemeal annexations, <br />as is evidenced by dedication of 38% of the land area for open <br />space, as opposed to the l2% required by the City Subdivision <br />Regulations. Therefore, in order that such open space dedications <br />occur as soon as reasonably possible so that the citizens of the <br />City of Louisville may receive the benefit of the increased public <br />health, safety and welfare at the earliest reasonable time, it <br />is the opinion of the City Council that an emergency exists and <br />that immediate effect of this Ordinance is necessary for the <br />preservation of the public peace, health and property. <br /> 3. The land to be dedicated for public use as a result <br />of this annexation will provide the opportunity to construct <br />much needed recreational facilities, including baseball fields <br />for which the City already has received a federal grant, and a <br />recreation center which is in the preliminary design phase and <br />which the citizens of Louisville have declared to be important <br />to community health, safety, and welfare. Therefore, so that the <br />citizens of the City of Louisville may receive the benefit of <br />increased recreation and facilities as soon as reasonably <br />possible, it is the opinion of the City Council that an emergency <br />exists and that immediate effect of this Ordinance is necessary <br />for the preservation of the public peace, health and property. <br /> 4. The City has heretofore suffered from a lack of <br />adequate sites for the construction of housing for senior <br />citizens and those persons of low and moderate income. This <br />annexation will provide such acceptable sites within the City <br />limits and alleviate the urgent need for such sites. Therefore, <br />it is declared that in the opinion of the City Council an <br />emergency exists and that immediate effect of this Ordinance <br />is necessary for the immediate preservation of public peace, <br />health, property, and safety. <br /> 5. A real and imminent threat to block or prohibit this <br />proposed annexation by various methods, some of which are a matter <br />of public record, has been made by a neighboring municipality. <br />Such threats and efforts could result in the City being involved <br />in costly and meaningless litigation at great expense to the <br />City's taxpayers. Therefore, in order to avoid such threats and <br />efforts, in an attempt to avoid costly legal expenses for the <br />citizens of the City of Louisville, it is the opinion of City <br />Council that an emergency exists and that immediate effect of this <br />Ordinance is necessary for the preservation of the public health, <br />safety and welfare. <br /> 6. Benefits of ad valorem taxes from the new commercial <br />activities coupled with anticipated sales tax revenues will provide <br />the funds necessary for the future operation of all City services <br />and therefore in order that the citizens of the City of Louisville <br />receive benefits from said revenues at the earliest possible time, <br />it is declared by City Council that an emergency exists and that <br />this Ordinance is necessary for the immediate preservation of the <br />public peace, health, property and welfare. <br /> -4- <br />
