<br /> . .., <br /> ORDINANCE NO. 653 <br /> AN ORDINANCE ADDING CHAPTER 10.16 <br /> TO THE LOUISVILLE MUNICIPAL CODE <br /> CONCERNING PARKING PRIVILEGES FOR <br /> THE HANDICAPPED. <br /> WHEREAS, the General Assembly of the State of Colorado <br /> has adopted specific legislation concerning the establishment and <br /> control of parking privileges for the handicapped; and <br /> WHEREAS, the City Council recognizes the need and <br /> reasoning to establish and control specific parking privileges <br /> for the handicapped. <br /> NO'W, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br /> THE CITY OF LOUISVILLE, COLORADO: <br /> Section 1. The following chapter is hereby added to <br /> Title 10 of the Louisville Municipal Code: <br /> Chapter 10.16 Parking Privileges for <br /> the Handicapped. <br /> 10.16.010 Handicapped Person <br /> As used in this Chapter, "handicapped person" means a <br /> person so severely handicapped that he is unable to move from <br /> place to place without the aid of a mechanical device. <br /> 10.16.020 Designated Parking Spaces <br /> (a) A handicapped person may park in a parking space <br /> identified as being reserve for use by the handicapped whether <br /> on public property or private property available for public <br /> use. A placard or license plate issued to a handicapped person <br /> shall be displayed on the vehicle while parked in such space. <br /> (b) The owner of private property available for public <br /> use may request the installation of official signs identifying <br /> parking spaces reserved for use by the handicapped. Such a <br /> request shall be a waiver of any objection which the owner may <br /> assert concerning enforcement of this section by the Police <br /> Department. <br /> 10.16.030 Violation - Designated <br /> It is unlawful for any pArson other than a handicapped <br /> person to park in a parking space on public or private property <br /> which is clearly identified by an official sign as being reserved <br /> for use by handicapped unless such person is parking the vehicle <br /> for the benefit of the handicapped person. <br /> 10.16.040 Violation - Penalty <br /> Any person who is not a handicapped person who parks in <br /> a designated handicapped parking area shall be guilty of violation <br /> hereof and shall be subject to the penalty provided in Section <br /> 1.28.010, except that the minimum fine for a violation of this <br />
