<br />RESOLUTION NO. 46 <br />SERIES 2004 <br /> <br />A RESOLUTION APPROVING A JOINT AND COOPERATIVE <br />INTERGOVERNMENTAL AGREEMENT FOR MEMBERSHIP IN THE GREATER <br />METRO TELECOMMUNICATIONS CONSORTIUM <br /> <br />WHEREAS, there exists a Greater Metro Telecommunications Consortium <br />("Consortium") comprised of municipalities, counties and other political subdivisions; and <br /> <br />WHEREAS, the City has concerns and objectives similar to other Consortium members <br />with regard to ensuring the provision of high quality cable television, data and communications <br />services, and the safe and efficient use of public rights-of-way, within its jurisdiction; and <br /> <br />WHEREAS, the City confronts many of the same challenges as other Consortium members <br />regarding the allocation of resources for and the monitoring and administration of cable <br />communication franchises and other telecommunications issues; and <br /> <br />WHEREAS, the City Council finds that membership in the Consortium will benefit the <br />citizens of Louisville; and <br /> <br />WHEREAS, to effect the City's membership in the Consortium, there has been proposed to <br />the City for its execution a Joint and Cooperative Intergovernmental Agreement for a Greater <br />Metro Telecommunications Consortium; and <br /> <br />WHEREAS, the City is authorized to enter into such agreement pursuant to state law, <br />including but not limited to the C.RS. sections 29-1-203 and 29-1-401. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br />1. The proposed Joint and Cooperative Intergovernmental Agreement for a Greater <br />Metro Telecommunications Consortium is hereby approved in essentially the same form as the <br />copy of such Agreement accompanying this Resolution. <br /> <br />2. The Mayor is hereby authorized to execute the Agreement on behalf of the City <br />Council of the City of Louisville, except that the Mayor is hereby granted the authority to negotiate <br />and approve such revisions to said Agreement as the Mayor determines are necessary or desirable <br />for the protection of the City, so long as the essential terms and conditions of the Agreement are not <br />altered. <br /> <br />PASSED AND ADOPTED this 19th day of October, 2 <br /> <br />
