No public officer shall request or permit the unu <br />authorized use of any City owned vehicles, equipment, personnel, <br />materials, or property for personal convenience or profit. <br /> J. No public officer or employee shall request or grant <br />an special consideration, treatment, or advantage to any citizen <br />beyond that which is available to every other citizen in similar <br />circumstances or need. <br /> K. A public official or employee shall not, at any time <br />within two years after his termination from the City, appear before <br />any Board, commission, committee, or agency of the City in relation <br />to or with respect to any matter in wht h he was directly involved <br />in the review, acceptance, policy formulation, or administration <br />of such matter while a city official or employee. <br /> L. At any meeting or gathering of three or more members <br />of the City Councilor any appointed Board of the City, the Council <br />or Board members shall not discuss any public business, nor shall <br />matters pertaining to public business be presented unless such <br />meeting is open to the general public and prior notice for such meet- <br />ing has been given. This section shall not apply to meetings de- <br />voted solely and entirely to personnel matters, attorney-client <br />matters, and/or to discuss the purchase or sale of water rights for <br />the City. <br /> 2.80.040 Disclosure <br /> A. A public officer or employee shall disclose any private <br />interest which he may have in an official act or transaction as follows: <br /> l. Any elected or appointed public official or employee <br />who has any financial interest in any proposed City action before <br />the City Councilor a City Board of which the public official/employee <br />is a member shall immediately disclose the nature of such interest, <br />with such disclosure to be a matter of public record. <br /> 2.80.050 Enforcement <br />Provisions of this Chapter shall be enforced as follows: <br /> A. The City Prosecuting Attorney shall have the primary <br />responsibility for the enforcement of this Code. He shall have the <br />power to investigate any complaint and to prosecute any criminal or <br />civil action on behalf of the City. <br /> B. Any person who believes that a violation of any portion <br />of this chapter has occurred and wishes to initiate proceedings on <br />such alleged violation shall file a written and signed complaint <br />with the City Council. <br /> C. The Mayor shall direct the City Prosecuting Attorney <br />to investigate or prosecute any apparent violation of this chapter <br />within 10 days. Should any alleged violation involve a member of <br />the City Councilor the City Attorney, the Mayor shall determine if <br />any grounds exist for such allegations to warrant the appointment <br />of a qualified attorney outside the City Prosecuting Attorney's staff <br />to investigate or prosecute any alleged violation. Should the alleged <br />violation involve the Mayor, City Council shall determine if any <br />grounds exist as to such allegations to warrant the appointment of <br />a qualified attorney outside the City Prosecuting Attorney's staff <br />to investigate or prosecute any alleged violation. <br /> D. In the event that either the Mayor or the City Council <br />refuses to act in good faith in appointing a special prosecutor for <br />alleged violations under this chapter, or the Prosecuting Attorney <br />refuses or fails to act 1n good faith in investigating or prose- <br />cuting an alleged violation under this chapter, the complaintant may <br />institute the appropriate civil action in the District Court of Boulder <br />County, seeking an Order for a special prosecutor. <br /> E. In the event the District Court determines that either <br />the City officials or the complaintant acted in "bad faith" relative <br />to such civil action, the Court in its discretion may award court <br />costs and reasonable attorney's fees to the prevailing party. <br /> 699/3 <br />
