ORDINANCE NO. 1595 <br /> SERIES 2011 <br /> AN ORDINANCE APPROVING A SECOND AMENDMENT TO A PLANNED <br /> COMMUNITY ZONE DISTRICT (PCZD) GENERAL DEVELOPMENT PLAN FOR <br /> PROPERTY DESIGNATED AS THE NORTH END <br /> WHEREAS, by Ordinance No. 1505, Series 2006, the City Council previously approved a <br /> Planned Community Zone District (PCZD) General Development Plan for property known as the <br /> North End; and <br /> WHEREAS, by Ordinance No. 1572, Series 2010, the City Council approved a first <br /> amendment to the North End PCZD General Development Plan; and <br /> WHEREAS, under such Plan, those areas designated as Planning Areas 1, 2 and 3 are <br /> zoned PCZD for, respectively, commercial, medium density residential, and low density residential; <br /> and <br /> WHEREAS, the owner of the property has submitted to the City a request for approval of a <br /> second amendment to the PCZD General Development Plan to allow for modifications to the <br /> 1,ound ries of Planning Areas 1, 2 and 3, as well as modification to the layout of the interior <br /> coaiways v vith such Planning Areas; and <br /> WHEREAS, after a duly noticed public hearing on June 7, 2011 concerning said second <br /> amendment to the PCZD General Development Plan, where evidence and testimony were entered <br /> into the record, including without limitation the findings in the Louisville Planning Commission <br /> Staff Report dated June 7, 2011, the Planning Commission recommended approval of such <br /> amendment to the City Council; and <br /> WHEREAS, the City Council has duly considered the Planning Commission's <br /> recommendation; and <br /> 'WHEREAS, the City Council has held a duly noticed public hearing on the proposed <br /> second amendment to the PCZD General Development Plan, at which evidence and testimony <br /> Were entered into the record, including without limitation the findings in the City Council staff <br /> report and other documents as listed in such report; and <br /> `1' H ER.I AS, based on the evidence and testimony in the record, the City Council finds <br /> ti'at the proposed second amendment to the PCZD General Development Plan complies with <br /> Louisville zoning regulations and policies, the principles and policies of the 2009 Citywide <br /> Comprehensive Nan, the requirements of the Planned Community Zone District chapter of the <br /> Louisville Municipal Code, and the criteria, requirements and provisions of other applicable <br /> sections of the Louisville Municipal Code, and that the proposed amendment should be <br /> approved, subject to certain conditions; <br /> Ordinance No. 1595, Series 2011 <br /> Page 1 of 3 <br />
