<br />D. No person shall maliciously destroy or interfere with BMPs <br />implemented to protect water quality. <br /> <br />Sec. 13.36.100. <br /> <br />Access and inspection of properties and facility. <br /> <br />A. Whenever the director of public works has reasonable cause to believe <br />that there exists, or potentially exists, in or upon any premises any condition which <br />constitutes a violation of this chapter, the director or the director's designee shall <br />have the right to enter the premises at any reasonable time to determine ifthe owner, <br />occupant or operator is complying with all requirements of this chapter. In the event <br />that the owner, occupant, or operator refuses entry after a request to enter has been <br />made, the city is hereby empowered to seek assistance from a court of competent <br />jurisdiction in obtaining such entry. <br /> <br />B. The director shall have the right to set up on the property of any <br />discharger to the MS4 such devices that are necessary to conduct an investigation of <br />such discharges. The investigation may include, but is not limited to the following: <br />sampling of any discharge or process waters, the taking of photographs, interviewing <br />staff on alleged violations, and access to any and all facilities or areas within the <br />premises that may have any effect on the discharge. <br /> <br />C. If the violation constitutes an immediate danger to public health or <br />public safety, the director is authorized to enter upon the subject private property, <br />without giving prior notice, to take any and all measures necessary to abate the <br />violation and/or restore the property. The city may recover from the owner the costs <br />of all such measures. <br /> <br />Sec. 13.36.110. <br /> <br />Suspension and termination of MS4 access. <br /> <br />A. Suspension due to IlIicit Discharges in Emergency Situations. The <br />director or his designee may, without prior notice, suspend MS4 discharge access to a <br />person when such suspension is necessary to stop an actual or threatened discharge, <br />which presents or may present imminent and substantial danger to the environment, <br />or to the health or welfare of persons, or to the MS4 or waters of the State. In the <br />event a violator fails to comply with a suspension order issued in an emergency, the <br />director may take such steps as deemed necessary to prevent or minimize damage to <br />the MS4 or waters of the State, or to minimize danger to persons. <br /> <br />B. Termination due to the Detection of Illicit Discharge. Any person <br />discharging to the MS4 in violation of this chapter may have their MS4 access <br />terminated if such termination would, in the judgment ofthe director, abate or reduce <br />an illicit discharge. The director shall provide written notice of the proposed <br />termination of MS4 access to the person(s) whose access is proposed to be <br /> <br />10 <br />
