section shall be certified by the director of finance to the office of the county treasurer for collection in the same manner as the collection of general property taxes. C. Stop Work Order. Whenever the director determines that activity is occurring in violation of the requirements ofthis chapter, the director can order the activity stopped upon service of written notice to the responsible owner and operator. The owner or operator shall immediately stop all activity until authorized in writing by the city to proceed. If the owner or operator cannot be located, the notice to stop shall be posted in a conspicuous place upon the area where the activity is occurring and shall state the nature of the violation. It shall be unlawful for any owner or operator to fail to comply with a stop work order. D. Civil Penalties. In the event the alleged violator fails to take the remedial measures set forth in the notice of violation or otherwise fails to cure the violations described therein within 10 days, the director of public works may impose a penalty not to exceed $1,000 for each day the violation continues after the receipt of the notice of violation. E. Criminal Penalties. Any person who violates any provision of this chapter shall be liable to criminal prosecution to the fullest extent of the law, and shall be subject to a criminal penalty of $1 ,000 dollars per violation per day and/or imprisonment for a period of time not to exceed 60 days or both such fine and imprisonment. F. Violations Deemed a Public Nuisance. Any condition caused or permitted to exist in violation of any of the provisions of this chapter is a threat to public health, safety, and welfare, and is declared and deemed a public nuisance. Any court of competent jurisdiction shall enjoin violations ofthis chapter, upon proof of such violations. G. Remedies Not Exclusive. Except as expressly provided above, the remedies in this chapter are cumulative and the exercise of anyone or more remedies shall not prejudice any other remedies that may otherwise be pursued for a violation of this chapter. The remedies listed in this chapter are not exclusive of any other remedies available under any applicable federal, state or local law and it is within the discretion of the authorized enforcement agency to seek cumulative remedies. Section 2. If any portion of this ordinance is held to be invalid for any reason, such decisions shall not affect the validity ofthe remaining portions ofthis ordinance. The City Council hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact that nay one part be declared invalid. Section 3.
