<br />section shall be certified by the director of finance to the office of the <br />county treasurer for collection in the same manner as the collection of <br />general property taxes. <br /> <br />C. Stop Work Order. Whenever the director determines that activity is <br />occurring in violation of the requirements ofthis chapter, the director can order the <br />activity stopped upon service of written notice to the responsible owner and operator. <br />The owner or operator shall immediately stop all activity until authorized in writing <br />by the city to proceed. If the owner or operator cannot be located, the notice to stop <br />shall be posted in a conspicuous place upon the area where the activity is occurring <br />and shall state the nature of the violation. It shall be unlawful for any owner or <br />operator to fail to comply with a stop work order. <br /> <br />D. Civil Penalties. In the event the alleged violator fails to take the <br />remedial measures set forth in the notice of violation or otherwise fails to cure the <br />violations described therein within 10 days, the director of public works may impose <br />a penalty not to exceed $1,000 for each day the violation continues after the receipt of <br />the notice of violation. <br /> <br />E. Criminal Penalties. Any person who violates any provision of this <br />chapter shall be liable to criminal prosecution to the fullest extent of the law, and <br />shall be subject to a criminal penalty of $1 ,000 dollars per violation per day and/or <br />imprisonment for a period of time not to exceed 60 days or both such fine and <br />imprisonment. <br /> <br />F. Violations Deemed a Public Nuisance. Any condition caused or <br />permitted to exist in violation of any of the provisions of this chapter is a threat to <br />public health, safety, and welfare, and is declared and deemed a public nuisance. <br />Any court of competent jurisdiction shall enjoin violations ofthis chapter, upon proof <br />of such violations. <br /> <br />G. Remedies Not Exclusive. Except as expressly provided above, the <br />remedies in this chapter are cumulative and the exercise of anyone or more remedies <br />shall not prejudice any other remedies that may otherwise be pursued for a violation <br />of this chapter. The remedies listed in this chapter are not exclusive of any other <br />remedies available under any applicable federal, state or local law and it is within the <br />discretion of the authorized enforcement agency to seek cumulative remedies. <br /> <br />Section 2. If any portion of this ordinance is held to be invalid for any reason, such <br />decisions shall not affect the validity ofthe remaining portions ofthis ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact <br />that nay one part be declared invalid. <br /> <br />Section 3. <br /> <br />The repeal or modification of any provision of the Municipal Code ofthe City of <br /> <br />16 <br />
