<br />Example: <br />(1) One share of Ditch & R<~servoir X Stock = 6 acre-feet (average annual yield) <br />(2) times 65% efficiency = 3.9 acre-feet (consumptive use) <br />(3) plus 4.0 acre-feet of storage = 7.9 Raw Water Credits. <br />4. If the following water rights are accepted by the City, the following Raw Water Credits shall <br />be applicable: <br />Water Rights Raw Water Credits <br /> (credits per share) <br />Marshall Lake 8.48 <br />South Boulder and Coal Creek Ditch 26.15 <br />Note: Marshall Lake and South Boulder and Coal Creek Ditch are based on the actual yield of the City's transferred rights. <br />5. For water rights acceptable to the City for dedication which are not set forth in Paragraph 4 <br />above, Raw Water Credits shall be determined by the City in the same manner as the Raw Water <br />Credits in paragraph 4 where determined, which determination shall include the criteria set forth <br />in paragraph 6, below. <br />6. The City shall evaluate water rights offered for dedication to the City and determine whether <br />or not the water rights are to be accepted based upon the following criteria: priority date, <br />historical point of diversion, location of historical use, historical yield, historical consumptive <br />use, the contribution to historical consumptive use of other water rights or sources of water <br />supply, future use of the land historically irrigated including future irrigation, considerations with <br />respect to title, anticipated difficulties with transferring the water rights to appropriate points of <br />diversion, places of storage and municipal uses, the City's contractual obligations and <br />arrangements, expected needs of the City and of the City's municipal water supply system, <br />composition of the City's water rights portfolio at the time of the proposed annexation, and any <br />other appropriate factors. <br />7. For all land, if the Raw Water Credits available from water rights offered and accepted by the <br />City are less than the Net Acreage, a cash payment in lieu of dedication or to supplement <br />dedication shall be required in the amount of$1,819.00 per acre times the difference between the <br />Net Acreage and the number of Raw Water Credits available. This fee shall be collected upon <br />approval of the first subdivision or PUD of the subject property or at such other time(s) as the <br />City may allow, in any case with the time of payment to be as provided in a written agreement <br />with annexor or its successors. <br />8. In the event the water rights offl~red to the City for dedication provide Raw Water Credits in <br />excess of those required by this policy, annexor shall offer any excess water rights for sale to the <br />City at current fair market value. The City may enter into a written agreement to purchase all or <br />part of any such excess water rights and, in the event the City does not then purchase all of such <br /> 2 <br />
