RESOLUTION NO.8 SERIES 2007 A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT BY AND BETWEEN THE LOUISVILLE FIRE PROTECTION DISTRICT AND THE CITY OF LOUISVILLE REGARDING PROVISION FOR FIRE SERVICES WHEREAS, pursuant to th~: Special District Act, 32-1-101 et seq., C.R.S., the Louisville Fire Protection District ("District") provides fire services to all areas within its boundaries; and WHEREAS, pursuant to 31-30-101 and 31-15 -601, C.R. S., the City is authorized to provide fire services within its municipal boundaries; and WHEREAS, pursuant to 29-1-203, C.R.S., the District and the City may contract with one another to provide any function, service, or facility lawfully authorized to be provided by the District or the City; and WHEREAS, most, but not all, of the area presently located within the boundaries of the City also is located within the boundaries of the District; and WHEREAS, an intergovemmental agreement has been proposed between the District and the City to provide uniform fire services and uniform enforcement of the fire code throughout the boundaries of the District and the City; and WHEREAS, the City Council finds that such proposed agreement will promote the public safety and welfare of current and future residents and property owners and will provide for cooperative efforts by both the City and the District for the provision of uniform fire services and uniform enforcement of the fire code throughout the District and the City, and the City Council desires to enter into such agreement;, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The proposed Intergovernmental Agreement By and Between the Louisville Fire Protection District and the City of Louisville Regarding Provision for Fire Services (the "Agreement") is hereby approved in essentially the same form as the copy of such Agreement accompanying this Resolution. 2. The Mayor is hereby authorized to execute the Agreement on behalf of the City Council of the City of Louisville including Exhibit "B" thereto, such Exhibit "B" being An Intergovernmental Agreement By and Between the City of Louisville and the Louisville Fire Protection District To Establish a Payment Schedule for Fire Protection Systems Permit and Plans Review ("Exhibit 'B "'). The Mayor is further hereby granted the authority to negotiate and approve such revisions to said Agreement ancl Exhibit "B" thereto as the Mayor determines are necessary or desirable for the protection of the City, so long as the essential terms and conditions of the Agreement are not altered.
