<br /> RESOLUTION NO.8 <br /> SERIES 2007 <br />A RESOLUTION APPROVING AN INTERGOVERNMENTAL <br />AGREEMENT BY AND BETWEEN THE LOUISVILLE FIRE <br />PROTECTION DISTRICT AND THE CITY OF LOUISVILLE <br />REGARDING PROVISION FOR FIRE SERVICES <br />WHEREAS, pursuant to th~: Special District Act, 32-1-101 et seq., C.R.S., the Louisville <br />Fire Protection District ("District") provides fire services to all areas within its boundaries; and <br />WHEREAS, pursuant to 31-30-101 and 31-15 -601, C.R. S., the City is authorized to <br />provide fire services within its municipal boundaries; and <br />WHEREAS, pursuant to 29-1-203, C.R.S., the District and the City may contract with <br />one another to provide any function, service, or facility lawfully authorized to be provided by the <br />District or the City; and <br />WHEREAS, most, but not all, of the area presently located within the boundaries of the <br />City also is located within the boundaries of the District; and <br />WHEREAS, an intergovemmental agreement has been proposed between the District <br />and the City to provide uniform fire services and uniform enforcement of the fire code <br />throughout the boundaries of the District and the City; and <br />WHEREAS, the City Council finds that such proposed agreement will promote the <br />public safety and welfare of current and future residents and property owners and will provide for <br />cooperative efforts by both the City and the District for the provision of uniform fire services and <br />uniform enforcement of the fire code throughout the District and the City, and the City Council <br />desires to enter into such agreement;, <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />1. The proposed Intergovernmental Agreement By and Between the Louisville Fire <br />Protection District and the City of Louisville Regarding Provision for Fire Services (the <br />"Agreement") is hereby approved in essentially the same form as the copy of such Agreement <br />accompanying this Resolution. <br />2. The Mayor is hereby authorized to execute the Agreement on behalf of the City <br />Council of the City of Louisville including Exhibit "B" thereto, such Exhibit "B" being An <br />Intergovernmental Agreement By and Between the City of Louisville and the Louisville Fire <br />Protection District To Establish a Payment Schedule for Fire Protection Systems Permit and Plans <br />Review ("Exhibit 'B "'). The Mayor is further hereby granted the authority to negotiate and approve <br />such revisions to said Agreement ancl Exhibit "B" thereto as the Mayor determines are necessary or <br />desirable for the protection of the City, so long as the essential terms and conditions of the <br />Agreement are not altered. <br />
