<br /> RESOLUTION NO. 15 <br /> SERIES 2007 <br />A RESOLUTION AFFIRMING THE CITY'S CODE OF ETHICS AS CONTAINED IN <br />THE CITY'S CHARTER AND MUNICIPAL CODE <br />WHEREAS, on November 7, 2006, the voters approved Amendment 41 on the statewide <br />general election ballot; and <br />WHEREAS, Amendment 41 adopts a new Article XXIX of the Colorado Constitution <br />entitled "Ethics in Government," which Article deals in detail with receipt of gifts and things of <br />value by, and lobbying and ethical principles applicable to, public officials; and <br />WHEREAS, by its terms, Amendment 41 applies to local government officials and <br />employees; and <br />WHEREAS, Section 7 of Amendment 41 provides that it does not apply to home rule <br />municipalities that have adopted charters, ordinances, or resolutions that address the matters <br />covered by Amendment 41; and <br />WHEREAS, Louisville's Code of Ethics, contained in Sections 5-6 through 5-17 of the <br />City's Charter and Chapter 2.80 of the Louisville Municipal Code (the "Code of Ethics"), applies <br />to all City officers, public body members and employees; and <br />WHEREAS, the Code of Ethics, which was first adopted in 1992 by Ordinance No. <br />1079, Series 1992, and adopted as part of the City Charter in 2001, is more comprehensive than <br />Amendment 41 in that it addresses prohibitions on receipt of gifts, activities related to city <br />contracting, hiring and supervision of personnel; outside employment; employment and <br />relationships after leaving an appointed or employment position with the City; use of city <br />vehicles and equipment, and other matters; and <br />WHEREAS, the Code of Ethics is more restrictive than Amendment 41 with respect to <br />its ban on gifts of items valued at over $15.00 (and potentially on gifts of any value), compared <br />with Amendment 41's ban on gifts of items valued at over $50.00; and <br />WHEREAS, City Council finds that the City's current Code of Ethics, contained in the <br />Charter, along with City ordinances pertaining to ethics contain appropriate restriction on matters <br />covered by Amendment 41; and <br />WHEREAS, City Council finds that it is in the best interest of the City to confirm that <br />the Charter, ordinances and other regulations of the City are applicable within the City, rather <br />than the requirements contained in Amendment 41, all as permitted by Amendment 41 itself. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLOR<\.DO: <br />1.
