<br />Section 2. The City Council herewith finds, determines and declares that this <br />ordinance is necessary for the immediate preservation of the public health and safety in <br />order to timely effectuate the amendment to the franchise set forth herein, so that the <br />current franchise is extended prior to the current expiration date thereof. This ordinance <br />shall take effect November 4, 2004, provided the same has been adopted and signed by <br />the Mayor and approved by two-thirds of the entire City Council. <br /> <br />Section 3. Nothing herein shall be constmed to prohibit amendment of the <br />franchise at any time during the extended term hereof in the matter provided by law, or to <br />prohibit any other arrangements that may be agreed upon or enacted during the extended <br />term hereof to address matters related to the franchise. <br /> <br />INTRODUCED, READ, PASSED, ADOPTED AS AN EMERGENCY <br />ORDINANCE BY A VOTE OF 7 TO 0, AND ORDERED PUBLISHED this 3rd day of <br />November, 2004 <br /> <br />/ j ~ /.7 <br />I/V ~/ <br /> <br /> <br />Charles L.
