<br /> ORDINANCE NO. 1514 <br /> SERIES 2007 <br />AN ORDINANCE AMENDING SECTION 2.80.030 OF THE LOUISVILLE MUNICIPAL <br />CODE BY ADDING SECTION 2.80.030.A(5), PERTAINING TO GIFT BANS AND <br />APPLICATION OF THE CODE OF ETHICS TO INDEPENDENT CONTRACTORS OF <br />THE CITY <br />WHEREAS, by Resolution No. 15, Series 2007, the City Council, acting pursuant to the <br />authority vested in it by Article XXIX, Section 7 and Article XX, Section 6 of the Colorado <br />Constitution, affirmed that the Louisville Charter and ordinances contain appropriate restrictions on <br />the matters covered by Article XXIX, and that the City's Charter and ordinances are applicable <br />within the City, rather than the requirements contained in Article XXIX of the Colorado <br />Constitution; and <br />WHEREAS, Louisville's Code of Ethics, contained in Sections 5-6 through 5-17 of the <br />City's Charter, applies to all City officers, public body members and employees; and <br />WHEREAS, Chapter 2.80 of the Louisville Municipal Code also sets forth the Code of <br />Ethics, including certain additional restrictions and applies to all City officers, public body <br />members and employees; and <br />WHEREAS, the City Council desires to amend Chapter 2.80 of the Louisville Municipal <br />Code to add provisions regarding gift bans for officers, public body members, and employees, as <br />well as certain independent contractors of the City, it being City Council's intent that such <br />provisions shall serve as additional restrictions beyond those set forth in the Charter; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />Section 1. Section 2.80.030.A of the Louisville Municipal Code is hereby amended <br />by adding a new subsection 2.80.030.A(5) to read as follows: <br />Sec. 2.80.030. Code of Ethi~~s <br />A(5) No officer, public body member, employee or independent <br />contractor who has the power or duty to perform, or has any influence over an <br />official action of the City shall solicit, accept or receive any gift or other thing of <br />value from any person seeking to influence the person's official action, as defined <br />section 5-7(e) of the city charter, or the person's official act, as defined in C.R.S. <br />S 24-18-102(7).* Nothing in this paragraph shall prohibit any officer, public body <br />member, employee or independent contractor from accepting an occasional <br />nonpecuniary gift of$15.00 or less in value, or from accepting an award, publicly <br />presented, in recognition of public service.
