He explained the Tree Haven <br /> Subdivision Agreement states the recovery fees for street improvements would be made <br /> at the time of the issuance of building permits. According to the Savage Annexation <br /> Agreement, Lots 1 and 3 will be required to pay the street improvement recovery fees. <br /> The annexation agreement does not require Lot 2, the existing house, to pay the fee. <br /> COUNCIL COMMENT <br /> Council member Van Pelt noted the Annexation Agreement had blank lines for street <br /> improvement recovery costs. City Attorney Light stated the Public Works Department <br /> would ascertain the recovery fees for street improvements. <br /> Rod Wilcox confirmed the recove:ry on Lots 1 and 3 were discussed with the City <br /> Manager, and would be collected upon issuance of building permits. <br /> Council member VanPelt asked Kristovich if she was aware the recovery fees were built <br /> into the agreement. Kristovich reported was inforined by Planning Director Wood that <br /> only Lots 1 and 2 of the Savage property would pay the street improvement recovery fee. <br /> City Attorney Light reminded Council that only the Savage Annexation is before Council <br /> this evening, and stated 135' of frontage would be unaddressed, if the Annexation <br /> Agreement was approved. <br /> Council member Keany asked what was conveyed to the Savage's relative to the street <br /> recovery fee. City Attorney Light stated the annexation agreement stated Lots 1 and 3 <br /> would pay the recovery fee. Mayor Sisk suggested the City look at Lot 2 and the 20' of <br /> frontage. <br /> Mayor Sisk closed the public hearing. <br /> RESOLUTION NO. 23, SERIES 2004 - A RESOLUTION CONCERNING A <br /> PETITION FOR THE ANNEXATION OF PROPERTY TO THE CITY OF <br /> LOUISVILLE, COLORADO, KNOWN AS THE SA V AGE ANNEXATION, AND <br /> FINDING THE AREA PROPOSED TO BE ANNEXED ELIGIBLE FOR <br /> ANNEXATION <br /> MOTION: Council member Van Pelt moved to approve Resolution No. 23, Series 2004, <br /> seconded by Council member Levihn. All in favor. <br /> APPROVAL OF ANNEXATION AND DEVELOPMENT AGREEMENT FOR <br /> THE SAVAGE PROPERTY <br /> Mayor Sisk opened the public hearing and called for public comment.
