<br />ORDINANCE NO. 1457 <br />SERIES 2004 <br /> <br />AN ORDINANCE AMENDING CHAPTER 5.08 OF THE LOUISVILLE <br />MUNICIPAL CODE TO ADOPT STANDARDS, PROCEDURES, AND <br />FEES FOR APPLICATIONS FOR LIQUOR TASTINGS AT RETAIL <br />LIQUOR STORES <br /> <br />WHEREAS, pursuant to House Bill 04-1021, the City may authorize liquor tastings at <br />retail liquor stores, and may adopt certain standards, procedures and fees for such tastings; and <br /> <br />WHEREAS, the City Council desires to amend the Louisville Municipal Code to allow <br />retail liquor store licensees within the City to conduct liquor tastings pursuant to certain statutory <br />requirements and application procedures to be set by the Louisville Local Licensing Authority. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Section 5.08.040, Fees--Application and registration fees, of the Louisville <br />Municipal Code, is hereby amended by the addition of a new subsection G to read as follows: <br /> <br />G. Each application for a liquor tastings permit shall be accompanied by a <br />liquor tastings fee in the amount of$50.00. <br /> <br />Section 2. The Louisville Municipal Code is hereby amended by the addition of a new <br />section 5.08.075, to read as follows: <br /> <br />5.08.075 <br /> <br />Liquor tastings. <br /> <br />A. The city hereby authorizes tastings to be conducted by retail liquor store <br />licensees in accordance with this section and pursuant to section 12-47-301, <br />C.R.S. Within the city, it is unlawful for any person or licensee to conduct <br />tastings unless a permit has been obtained in accordance with this section. The <br />local licensing authority is authorized to issue tasting permits in accordance with <br />the requirements of this section. <br /> <br />B. A retail liquor store licensee that wishes to conduct tastings shall submit <br />an application for a tastings permit to the local licensing authority annually at the <br />time of liquor license renewal. The local licensing authority may reject the permit <br />application if the applicant fails to establish that the licensee is able to conduct <br />tastings without violating the provisions of this section or creating a public safety <br />risk to the neighborhood. The local licensing authority shall in its bylaws <br />establish application procedures for tastings permits. <br /> <br />C. Tastings shall be subject to the following limitations: <br /> <br />1 <br />
