He stated that the Urban
Drainage & Flood Control District does have funds available to reimburse communities
for purchasing land that is located in the 100-year floodplain. The City is eligible to
receive reimbursement from the Urban Drainage & Flood Control District for the portion
of the Warembourg property that lies within the 100-year floodplain. He stated that the
agreement has not been finalized. Boulder County received word today that the Urban
Drainage & Flood Control District would like a finalized agreement by Thursday,
November 18 in order to provide reimbursement before the end of the calendar year. The
reimbursement, which would be split equally between Boulder County and the City of
Louisville, could be up to $420,000. Simmons explained that Resolution No. 54, Series
1999, if passed, approves the proposed agreement regarding acquisition of Warembourg
floodplain land and authorizes the Mayor or Mayor Pro-Tem to execute the agreement
and make any necessary changes that are deemed to be in the best interests of the City,
provided the essential terms and conditions of the agreement are not altered.

Sisk called for Council comments and questions.

Keany asked Simmons whether the funds for reimbursement would be coming out of
future funding for floodplain projects.

Simmons replied that the reimbursement funds are provided by a preservation fund that
was established by the Urban Drainage & Flood Control District and agreed to clarify

9
