ORDINANCE NO. 1598 <br /> SERIES 2011 <br /> AN ORDINANCE AMENDING CHAPTER 4.03 OF THE LOUISVILLE MUNICIPAL CODE TO <br /> MAKE THE PROVISIONS OF SUCH CHAPTER CONSISTENT WITH THE OPEN SPACE <br /> PROVISIONS OF ARTICLE 15 OF THE CITY OF LOUISVILLE HOME RULE CHARTER, AND <br /> AMENDING CHAPTER 4.02 OF THE LOUISVILLE MUNICIPAL CODE REGARDING TERMS <br /> OF OFFICE FOR THE LOUISVILLIE CITIZENS OPEN SPACE ADVISORY BOARD <br /> WHEREAS, the City of Louisville is a Colorado home rule municipal corporation duly <br /> organized and existing under laws of the State of Colorado and the City Charter; and <br /> WHEREAS, Article 15 of the City Charter provides for management standards for City <br /> owned open space lands; and <br /> WHEREAS, Chapter 4.03 of the Louisville Municipal Code, which was enacted prior to <br /> adoption of the City Charter, sets forth standards for the acquisition, management, restoration, <br /> use and preservation of open space lands; and <br /> WHEREAS, several of the management standards set forth in Chapter 4.03 are <br /> inconsistent with the standards in Article 15 of the City Charter, and the City Council by this <br /> ordinance desires to amend Chapter 4.03 to make the provisions of such Chapter consistent with <br /> the management standards for City -owned open space lands outlined in Article 15; and <br /> WHEREAS, the City Council by this ordinance desires to amend Section 4.02.010 of the <br /> Louisville Municipal Code so that terms of office for the Louisville Citizens Open Space Advisory <br /> commence at the beginning of the calendar year; and <br /> WHEREAS, City Council has provided notice of a public hearing on said ordinance by <br /> publication as provided by law and held a public hearing as provided in said notice; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> LOUISVILLE, COLORADO: <br /> Section 1. Section 4.03.010 of the Louisville Municipal Code is hereby amended to <br /> read as follows (words to be deleted are shown in strikeout; words to be added are underlined): <br /> Sec. 4.03.010. Classification and management. <br /> Open space shall be managed in a manner consistent with good stewardship and sound <br /> ecological principles that benefits citizens of Louisville by promoting native plants, wildlife, <br /> wildlife and plant habitat, cultural resources, agriculture and scenic vistas and appropriate <br /> passive recreation. It is intended that the differing classifications of open space will require <br /> different management policies to provide reasonable levels of protection consistent with the <br /> intended uses of the land.
