Section 31-12-119. <br /> <br />General; legislative intent. <br /> <br />A. The provisions of this chapter govern all requests for disconnection <br />of land from the city. The provisions of C.RS. 931-12-501 .et.s.eq..., C.RS. 931-12- <br />601 .et.s.eq..., and C.RS. 931-12-701 .et.s.eq..., by their terms, do not apply to the city <br />and no disconnection from the city may be sought from the city pursuant to such <br />parts. <br /> <br />B. It is the intent of the city council to exercise the powers granted to <br />home mle municipal corporations by section 6 of article XX of the Colorado <br />Constitution in order to establish a non-judicial procedure for the disconnection of <br />land from the city. <br /> <br />C. It is further the intent of the city council to adopt the procedures <br />that apply to, and to adopt certain additional requirements for, proceedings under <br />C.RS. 931-12-119, to the extent such section requires the City to consider a <br />petition for disconnection pursuant thereto. <br /> <br />Sec. 16.34.020 <br /> <br />Definitions. <br /> <br />When not clearly otherwise indicated by the context, the following words, <br />terms and phrases, as used in this Chapter, shall have the following meanings: <br /> <br />Landowner means the owner in fee of any undivided interest in a given <br />parcel of land. If the mineral estate has been severed, the landowner is the owner <br />in fee of an undivided interest in the surface estate and not the owner in fee of an <br />undivided interest in the mineral estate. <br /> <br />2 <br />
