<br />Planning Commission <br />Meeting Minutes <br />APRIL 12, 2007 <br />Page 3 of 9 <br /> <br />Questions of Staff: <br />Loo inquired when the Ordinance is scheduled to be heard before City Council. <br /> <br />Wood stated the second reading of the repeal is set for May 1, 2007 with a public open house to <br />be scheduled toward the end of May to get public input on a new Ordinance. <br /> <br />Lipton asked if a boat on a trailer is considered a motor vehicle. <br /> <br />Wood briefly discussed the definition of a motor vehicle and explained in his opinion there are <br />gaps, such as this example, that need to be addressed in a new ordinance. <br /> <br />Lipton stated a replacement ordinance should be ready to be acted upon at the same time as the <br />repeal of the old ordinance occurs. <br /> <br />Additional Staff Presentation: <br />Wood introduced, Bill Kingston, Operations Commander, Louisville Police Department. <br /> <br />Kingston stated he came to address the questions of the Commission. <br /> <br />Lipton asked why the ordinance was difficult to enforce. <br /> <br />Kingston stated a group of residents made their desires known, which is what created the <br />ordinance and then another group of residents came forward with concerns after the ordinance <br />became effective. <br /> <br />Sheets asked if the Police Department had suggestions for a revised / new ordinance. <br /> <br />Kingston stated they have a list of items to be addressed but the Commission should keep in <br />mind there is no perfect ordinance that will please everyone. <br /> <br />Lipton asked what the expressed concerns were that discontinued the enforcement of the <br />ordinance. <br /> <br />Kingston stated the concerns included the definitions for side yard, front and rear as well as the <br />definition for trailer. <br /> <br />Loo asked if the new ordinance would include a current registration on the vehicle and suggested <br />the department should investigate whether or not this was a good requirement. <br /> <br />Hartman asked how many complaints are received per year. <br /> <br />Kingston stated less than a dozen and most of them are resolved with a visit to the owner and <br />then follow-up to the complainant. <br /> <br />Members of the Public: <br />None heard. <br /> <br />Public Hearing Closed / Commission Comments: <br />Dalton stated he supports the direction of City Council to repeal Ordinance 1397 because an un- <br />enforced Ordinance is like having no Ordinance. <br /> <br />Hartman stated she supports the repeal. <br /> <br />Loo stated she would like to see the repeal of the Ordinance and the replacement Ordinance to <br />move forward at the same time. <br /> <br />Lipton, Pritchard, Sheets and McAvinew stated their agreement with Loo. <br /> <br />Dalton requested to ask Kingston a question. <br />
