<br />1. All CMRS facilities of any nature installed in accordance with this Chapter <br />shall be fully maintained by the applicant at its expense. Maintenance shall <br />include protection from unsecured access and vandalism, and shall also include <br />repairs, upgrades and any other maintenance necessary to ensure the continued <br />safety of all facilities. Any damages to any facilities, from whatever source, <br />shall be repaired promptly, and at a maximum, within two weeks of occurrence. <br /> <br />2. The applicant shall provide, protect and maintain all landscaping in a healthy <br />and growing condition. The applicant shall immediately remove and replace <br />dead or diseased plant and other landscaping materials with the same type, size <br />and quantity of materials as originally installed. <br /> <br />3. Once every two years, and within thirty days of the anniversary of the <br />approval of the application, the applicant shall arrange for inspection of the <br />facilities, shall provide to the City an inspection of the facilities, and shall <br />provide to the City an inspection report verifying that any facility installed in <br />accordance with this Chapter is safe, meets all building requirements and <br />applicable emissions standards (e.g., FCC standards for RF/EMF emissions), is <br />not interfering with any emergency, public safety or similar facilities, and is <br />otherwise in compliance with all applicable rules, regulations, and laws. This <br />inspection shall be in addition to any other inspections necessary or required <br />under any other City ordinance, regulations or codes. <br /> <br />4. Maintenance of facilities installed in accordance with this Chapter shall be <br />conducted at such times and in such a manner as to not disturb the peace, quiet <br />and comfort of neighboring residents. Any auxiliary power source shall only be <br />run during emergencies. <br /> <br />F. Undergrounding of Utilities. Nothing in this Chapter shall limit any authority of <br />the City to require burial of utility lines and removal of utility poles. The CMRS <br />Provider shall, at its expense, and at or before the time of removal of utility lines, <br />remove any CMRS facilities located upon any utility pole which is to be removed <br />pursuant to the City's exercise of its authority to require burial of utility lines and <br />removal of utility poles. At the time the City exercises such authority, the City shall <br />provide notice of the undergrounding project to any affected CMRS Provider(s). <br /> <br />Section 2. Section 17.16 of the LMC, entitled 'General Regulations' is hereby <br />amended by the addition of the following Section 17.16.270, to include regulations for <br />Commercial satellite dish antennae. <br /> <br />17.16.270 Commercial Satellite Dish Antennae. <br /> <br />A. Commercial satellite dish antennae shall comply with the standards and <br />guidelines contained in Section 17.16.270.
