Purpose. The purpose of this Chapter of the Louisville Municipal Code <br />(LMC) is to provide specific regulations related to the location, height, design, construction <br />and review processes for CMRS facilities. 'The provisions of this Chapter are intended to <br />provide for consistent treatment of all applications for such facilities. It is the City's intent to <br />accommodate the growth of these industries in a reasonable and nondiscriminatory manner that <br />is consistent with the community aesthetic and design goals and provides a high level of <br />communication services to the citizens of Louisville. <br /> <br />17.42.020. Review Process. <br /> <br />A. It shall be unlawful for any person, firm or corporation to erect, construct or <br />operate any CMRS antenna or facility without complying with the provisions of this <br />Chapter and obtaining a permit therefor from the City. A permit may be obtained only <br />by means of an application duly filed in accordance with the requirements of this <br />Chapter. Any application not including all required information shall not be considered <br />duly filed. <br /> <br />B. All CMRS facilities are subject to a design review process and the approval or <br />disapproval of the City. Each applicant shall attend a preapplication conference <br />with the Planning Division to detennine which review process wiU be required. That <br />review process varies according to the type of facility proposed and the zone district in <br />which the facility is proposed to be located. The review process is intended to ensure <br />that the facility will be designed and sited in a manner that complies with the provisions <br />of this Chapter, and in such a way to minimize negative visual and physical impacts on <br />surrounding property. <br /> <br />C. The following tables outline the types of CMRS facilities allowed and where <br />allowed, and the required review process by type of application and zoning district <br />classification. <br /> <br />2 <br />
