<br />.... <br /> <br />r <br />, <br /> <br />ORDINANCE NO. 1257 <br />SERIES 1997 <br /> <br />AN ORDINANCE APPROVING AN OUT-OF-CITY WATER SERVICE AGREEMENT <br />BETWEEN THE CITY OF LOUISVILLE AND COLUMBINE LAND RESOURCES, INC. <br /> <br />WHEREAS, the City of Louisville and the County of Boulder have <br />previously purchased for open space purposes of a parcel of land <br />located adjacent to the north boundary of the City of Louisville <br />and the Hillsborough North Subdivision; and <br /> <br />WHEREAS, as part of such purchase, the City and the Seller, <br />Columbine Land Resources, Inc. ("Columbine"), agreed to negotiate <br />an out-of-City water service agreement to provide City water to <br />certain property retained by Columbine; and <br /> <br />WHEREAS, the City and Columbine have negotiated a proposed <br />water service agreement, and the City is willing to provide water <br />service to Columbine upon the terms and conditions described in a <br />mutually-agreeable water service agreement. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. The proposed Water Service Agreement between <br />the City of Louisville and Columbine Land Resources, Inc. is hereby <br />approved in essentially the same form as the copy of such Water <br />Service Agreement accompanying this Ordinance as Exhibit A. <br /> <br />Section 2. The water service provided pursuant to such <br />proposed Water Service Agreement shall not be subject to Subsection <br />16.32.050.B of the Louisville Municipal Code, which would otherwise <br />require an agreement to annex as a condition of out-of-City water <br />service, and which requirement is hereby waived. <br /> <br />Section 3. The Mayor is authorized to execute the Water <br />Service Agreement on behalf of the City, except the Mayor is hereby <br />granted the authority to negotiate and approve such revisions to <br />said Water Service Agreement as the Mayor determines are necessary <br />or desirable for the protection of the City, so long as the <br />essential terms and conditions of the Agreement are not altered. <br /> <br />Section 4. The Mayor, City Administrator and City staff <br />are further authorized to do all things necessary on behalf of the <br /> <br />1 <br />
