i <br />oulder County t,erk Cu * <br />bb.00 <br />1693164 <br />Page: 1 of 13 <br />04/24/199708:47A <br />D 0.00 <br />WATER SERVICE AGREEMENT <br />THIS AGREEMENT is made this /5/J day of 10a , 1997, by <br />and between the CITY OF LOUISVILLE, a' Colorado municipal <br />corporation (hereinafter referred to as the "City"), and COLUMBINE <br />LAND RESOURCES, INC., a Colorado Corporation, whose address is P.O. <br />Box 17130, Boulder, Colorado, 80308-0130 (hereinafter "Columbine"). <br />W ITNESET H: <br />WHEREAS, Columbine is the owner of certain real property <br />located in Boulder County, Colorado, and more particularly <br />described on Exhibit A, attached hereto and incorporated herein by <br />this reference, which property consists of three legal lots lying <br />outside of the municipal boundaries of the City (hereinafter <br />referred to individually as "Parcel 1", "Parcel 2", and "Parcel 3" <br />or collectively as the "Property"); and <br />WHEREAS, the City owns and operates the City of Louisville <br />Water Activity Enterprise to provide water service in accordance <br />with the laws of the State of Colorado and municipal ordinances and <br />policies of the City, and this Agreement is entered into pursuant <br />to those laws and ordinances: and <br />WHEREAS, in the operation of its water system, the City has <br />the authority to provide extraterritorial water service to <br />properties located outside the Citv's municipal boundaries; and <br />WHEREAS, the City is willing to extend water service to <br />Parcels 1-3 upon the terms and conditions of this Agreement; and <br />WHEREAS, Columbine and the City desire to set forth their <br />mutual understandings concerning Columbine's use of the City water <br />system, and related matters. <br />NOW, THEREFORE, for and in consideration of the recitals, <br />promises and covenants contained herein, and other good and <br />valuable consideration, the receipt and sufficiency of which is <br />hereby acknowledged, Columbine and the City agree as follows: <br />1. Water Tabs Approved. The City approves the purchase by <br />Columbine of three (3), three-quarter inch (3/4") domestic <br />residential water taps for service to Parcels 1-3 at the outside <br />City tap fee rate in effect at the time application is made for a <br />tap permit for the first tap. (By way of example, if application <br />for the first tap is made in 1997, Columbine shall pay the 1997 <br />outside City tap fee of $16,920 each, for a total tap fee of <br />$50,760.00.1 The City further agrees to provide City water service <br />to Parcels 1-3 subject to this Agreement, and all applicable <br />ordinances, rules and regulations of the City as may exist from <br />1 <br />
