<br />1111111111111111111111 <br /> <br />Boulder County Clerk, CO UACATION R 11.88 <br /> <br />1706578 <br />Page: 1 of 2 <br />86/16/1997 18: 56A <br />08.88 <br /> <br />~ <br /> <br />VACATION OF EASEMENT <br /> <br />THIS VACATION OF EASEMENT is made this Jd; day of April, 1997, by <br />the City of Louisville, a municipal corporation existing under and <br />by virtue of the laws of the State of Colorado ("City"), whose <br />address is 749 Main Street, Louisville, Colorado 80027. <br /> <br />RECITALS <br /> <br />WHEREAS, by document recorded as Film No. 1506, Reception No. <br />892232, Boulder County Records, the City in 1987 was granted a 25- <br />foot wide easement for sewer utility purposes; and <br /> <br />WHEREAS, a portion of such easement crosses Lots 118-125, Coal <br />Creek Ranch Filing No.3, Replat "A", as shown on the plat recorded <br />April 1, 1991, as Film No. 1667, Reception No. 1095018 and more <br />particularly described on Exhibit A, attached hereto and <br />incorporated herein by this reference (hereinafter the "Sewer <br />Easement"); and <br /> <br />WHEREAS, in the Subdivision Agreement for Coal Creek Ranch <br />Filing No.3, the City and the Subdivider agreed the existing sewer <br />line in the Sewer Easement would be connected to the sewer lines <br />for the subdivision, and that the Sewer Easement would thereafter <br />be vacated upon proper application to the City; and <br /> <br />WHEREAS, the work contemplated in the Subdivision Agreement <br />has been completed and accepted by the City, and proper application <br />has been made to the City for vacation of the Sewer Easement; and <br /> <br />WHEREAS, at this time no City sewer or other utilities run <br />through the Sewer Easement; and <br /> <br />WHEREAS, it is apparent that the existence of the Sewer <br />Easement to be vacated unduly interferes with the use and occupancy <br />of Lots 118-125, Coal Creek Ranch Filing No.3, Replat "A"; and <br /> <br />WHEREAS, the City Council has determined that the Sewer <br />Easement is and will not be needed for any public purposes; and <br /> <br />WHEREAS, the Sewer Easement is not being used or held for park <br />purposes or for any other governmental purpose. <br /> <br />1 <br /> <br /> <br />n <br />(:) <br />(:) <br />:;;0 <br />o <br /> <br /> <br />GO <br />GO <br /> <br />- -0.... <br />=~.2::..... <br />~~~CI.) <br />~~ 0) <br /><:DW~ <br /><:DoN <br />~ .., CI.) <br />-~ <br />n:. <br />GO <br />= <br />
