<br />ORDINANCE NO. 1247 <br />SERIES 1997 <br /> <br />AN ORDINANCE APPROVING A LEASE AGREEMENT BETWEEN THE CITY OF <br />LOUISVILLE AND DUANE DAUGHENBAUGH AND RUSSELL DAUGHENBAUGH <br /> <br />WHEREAS, the City of Louisville is the owner of a parcel of <br />land of approximately 20 acres, located adjacent to Heritage Park <br />at 8791 Cherry Street, Louisville, Colorado, and more particularly <br />described on Exhibit A, attached hereto and incorporated herein by <br />this reference (hereinafter the "City Property") i and <br /> <br />WHEREAS, the City desires to lease the City Property to Duane <br />Daughenbaugh upon the terms and conditions described in a mutually- <br />agreeable Lease Agreement. <br /> <br />WHEREAS, the City Council by this ordinance desires to approve <br />such lease as required by Section 31-15-712, Colorado Revised <br />Statutes. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. The proposed Lease Agreement between the City <br />of Louisville and Duane Daughenbaugh regarding the City Property, <br />as more particularly described on Exhibit A, is hereby approved in <br />essentially the same form as the copy of such Lease Agreement <br />accompanying this Ordinance. <br /> <br />Section 2. The Mayor is authorized to execute the Lease <br />Agreement, except that the Mayor is hereby granted the authority to <br />negotiate and approve such revisions to said Lease Agreement as the <br />Mayor determines are necessary or desirable for the protection of <br />the City, so long as the essential terms and conditions of the <br />Lease Agreement are not altered. <br /> <br />Section 3. If any portion of this ordinance is held to be <br />invalid for any reason, such decision shall not affect the validity <br />of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each <br />part hereof irrespective of the fact that anyone part be declared <br />invalid. <br />
