RESOLUTION NO. 52 <br /> SERIES 2011 <br /> A RESOLUTION APPROVING ADDITIONAL EXCHANGES OF CONSERVATION <br /> EASEMENTS REQUIRED BY THE SOUTHEAST BOULDER COUNTY, SOUTH 96TH <br /> STREET, DILLON ROAD AND US 287 AREA COMPREHENSIVE DEVELOPMENT <br /> PLAN INTERGOVERNMENTAIL AGREEMENT <br /> WHEREAS, the City of Louisville, City of Lafayette, City and County of Broomfield and <br /> County of Boulder are parties to the Southeast Boulder County, South 96th Street, Dillon Road <br /> and US 287 Area Comprehensive Development Plan Intergovernmental Agreement, dated <br /> February 18, 1999, and recorded in the Boulder County Clerk and Recorder's Office on March <br /> 15, 1999, at Reception Number 1916399, as previously amended "Northwest Parkway IGA <br /> and <br /> WHEREAS, the parties entered into the Northwest Parkway IGA in order to plan for <br /> future development and annexations within the southeast portion of Boulder County and for the <br /> construction of the Northwest Parkway; and <br /> WHEREAS, the Northwest Parkway IGA was amended by the parties on February 6, <br /> 2001, which amendment was recorded in the Boulder County Clerk and Recorder's Office on <br /> August 24, 2001, at Reception Number 2189244 "Amendment and <br /> WHEREAS, paragraph 6.3 of the text portion of Exhibit A of the Northwest Parkway <br /> IGA and paragraph 4.3 of the Amendment require that the parties convey to each other reciprocal <br /> conservation easements over and across all open space properties within an area defined in the <br /> Northwest Parkway IGA; and <br /> WHEREAS, by Resolution No. 70, Series 2010, the City Council approved certain <br /> exchanges of conservation easements in order to implement said requirements; and <br /> WHEREAS, in order to further implement said requirements, there have been prepared <br /> and presented to the City Council additional grants and assignments of conservation easements in <br /> gross over certain open space properties within the area defined in the Northwest Parkway IGA, <br /> including specifically the following instruments (which are collectively referred to as the <br /> "Conservation Easements <br /> 1. Deed of Conservation Easement in Gross Outlots C and D Broomfield Business <br /> Center (granting from Broomfield to Louisville, Lafayette, and Boulder County a <br /> conservation easement in gross over Outlots C and D, Broomfield Business Center <br /> Filing No. 1, consisting of approximately 5.4 acres); <br /> 2. Deed of Conservation Easement in Gross Located Near Parkway Circle /96 Street <br /> (granting from Broomfield to Louisville, Lafayette, and Boulder County conservation <br /> easements in gross over four parcels consisting of approximately 22.5 acres, located <br /> as depicted on Exhibit B to said instrument); and <br /> Resolution No. 52, Series 2011 <br /> Page 1 of 2 <br />
