3. Partial Assignment of Deed of Conservation Easement in Gross Anderson Triangle <br /> Property (assigning from Broomfield to Louisville, Lafayette, and Boulder County an <br /> undivided interest in a deed of conservation easement in gross over the Anderson <br /> Triangle Property, consisting of approximately 1.005 acres, located as depicted on <br /> page 11 of said instrument); and <br /> WHEREAS, the City Council finds that approval and execution of the Conservation <br /> Easements is in furtherance of the purposes, intent and requirements of the Northwest Parkway <br /> IGA and Amendment; and <br /> WHEREAS, the City Council finds that approval and execution of the Conservation <br /> Easements is in furtherance of the public benefit to be served by the preservation of the parcels <br /> subject to said Easements, as described in the City of Louisville planning documents; and <br /> WHEREAS, the City Council by this Resolution desires to approve the Conservation <br /> Easements and authorize their execution, upon the condition that all of the Conservation <br /> Easements are also executed by all of the other parties thereto; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF LOUISVILLE, COLORADO: <br /> Section 1. The foregoing recitals are hereby incorporated into this Resolution and made <br /> a part hereof. <br /> Section 2. The City Council hereby approves the Conservation Easements in the forms <br /> thereof accompanying this Resolution. <br /> Section 3. The Mayor is hereby authorized to execute the Conservation Easements on <br /> behalf of the City Council of the City of Louisville; provided, however, that the Mayor is hereby <br /> further authorized to negotiate and approve such revisions to the Conservation Easements as the <br /> Mayor determines are necessary or desirable for the protection of the City, so long as the essential <br /> terms and conditions of such Amendment are not altered. <br /> Section 4.
