ORDINANCE NO. 1600 <br /> SERIES 2011 <br /> AN ORDINANCE AMENDING SECTION 5.08.060 OF THE LOUISVILLE MUNICIPAL <br /> CODE CONCERNING SPECIAL EVENTS PERMITS <br /> WHEREAS, the Colorado legislature during the 2011 legislative session considered and <br /> adopted Senate Bill 11 -066, which allows local licensing authorities to issue special events permits <br /> without obtaining the approval of the State Licensing Authority; and <br /> WHEREAS, the Louisville Local Licensing Authority (the "Authority has reviewed <br /> Senate Bill 11 -066 and the special event permitting procedures set forth in the Louisville Municipal <br /> Code and has forwarded to the City Council the amendments to Section 5.08.060 of the <br /> Louisville Municipal Code as set forth herein; and <br /> WHEREAS, the City Council desires to amend Section 5.08.060 of the Louisville <br /> Municipal Code to authorize the Authority to elect, by resolution, to issue special events permits <br /> without obtaining the approval of the State Licensing Authority; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br /> CITY OF LOUISVILLE, COLORADO: <br /> Section 1. Section 5.80.060 of the Louisville Municipal Code is hereby amended to <br /> read as follows (words to be added are underlined; words to be deleted are stricken through): <br /> Sec. 5.08.060. Special event permits; generally. <br /> The City Local Licensing Authority may issue a special event permit for <br /> the sale, by drink only, of malt, spirituous, or vinous liquor to organizations <br /> qualifying under C.R.S. 12 -48 -101 et seq. The Local Licensing Authority may, <br /> by resolution, elect to issue special events permits without notifying the State <br /> Licensing Authority to obtain its approval or disapproval of applications for special <br /> events permits, which such resolution may be repealed or amended from time to <br /> time. <br /> Section 2. If any portion of this ordinance is held to be invalid for any reason, such <br /> decisions shall not affect the validity of the remaining portions of this ordinance. The City <br /> Council hereby declares that it would have passed this ordinance and each part hereof <br /> irrespective of the fact that any one part be declared invalid. <br /> Section 3. All other ordinances or portions thereof inconsistent or conflicting with <br /> this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or <br /> conflict. <br /> Ordinance No. 1600, Series 2011 <br /> Page 1 of 2 <br />
