ORDINANCE NO. 1601 <br /> SERIES 2011 <br /> AN ORDINANCE APPROVING AN AMENDMENT TO THE TAKODA GENERAL <br /> DEVELOPMENT PLAN TO REZONE A 5.93 -ACRE PARCEL FROM AGRICULTURE <br /> (A) AND OFFICE (0) TO PLANNED COMMUNITY ZONE DISTRICT RESIDENTIAL <br /> (PCZD -R) AND PLANNED COMMUNITY ZONE DISTRICT <br /> COMMERCIAL/RESIDENTIAI. (PCZD -C/R) <br /> WHEREAS, the City Council by Ordinance No. 1536, Series 2008, previously approved <br /> a Planned Community Zone District (PCZD) General Development Plan for property known as <br /> Takoda; and <br /> WHEREAS, the City Council by Ordinance No. 1576, Series 2010, previously approved <br /> an amendment to the PCZD General Development Plan to allow for a density transfer of 20 <br /> residential dwelling units from Planning Areas 2 and 3 to Planning Area 4 and to revise certain <br /> residential development bulk and dimension standards; and <br /> WHEREAS, RMCS, LLC, the owner of Planning Area 4 of the Takoda PCZD General <br /> Development Plan, has submitted to the City a request for approval of an amendment to the <br /> PCZD General Development Plan to rezone a 5.93 -acre parcel owned by RMCS, LLC from <br /> Agriculture (A) and Office (0) to Planned Community Zone District Residential (PCZD -R) and <br /> Planned Community Zone District Commercial /Residential (PCZD -C /R), and to make other <br /> revisions to the General Development Plan provisions applicable to Planning Area 4 in <br /> connection therewith; and <br /> WHEREAS, after a duly noticed public hearing on July 14, 2011 concerning said <br /> amendment to the PCZD General Development Plan, where evidence and testimony were <br /> entered into the record, including without limitation the findings in the Louisville Planning <br /> Commission Staff Report dated July 14, 2010, the Planning Commission recommended approval <br /> of such amendment to the City Council; and <br /> WHEREAS, the City Council has duly considered the Planning Commission's <br /> recommendation; and <br /> WHEREAS, the City Council has held a duly noticed public hearing on the proposed <br /> amendment to the PCZD General Development Plan, at which evidence and testimony were <br /> entered into the record, including without limitation the findings in the City Council staff report <br /> and other documents as listed in such report; and <br /> WHEREAS, based on the evidence and testimony in the record, the City Council finds <br /> that the proposed amendment to the PCZD General Development Plan, subject to conditions, <br /> Ordinance No. 1601, Series 2011 <br /> Page 1 of 3 <br />
