Rule Charter ( "Code of Ethics "). For purposes of application of such Code of Ethics
<br />only, the Council shall be considered a "public body" and a member of the Council shall
<br />be considered a "public body member."
<br />Section 3. Amendment of Bylaws The Bylaws of the Council may be amended
<br />only upon the vote of at least seven (7) members of the Council.
<br />Section 4. Conflict of Law. Where any conflict exists between any provision of
<br />these Bylaws and the Louisville Home Rule Charter or City ordinances, such ordinances
<br />or statutes shall control over the provisions of these Bylaws and these Bylaws shall be
<br />deemed to have been amended to conform to such ordinances and statutes.
<br />ARTICLE VI
<br />NON - DISCRIMINATION
<br />Section 1 General. It is the policy of the Council that neither the institution nor any staff
<br />member, volunteer or contractor with the Council shall discriminate against any
<br />individual on the basis of age, race, color, national origin, citizenship, ancestry, religion,
<br />creed, gender, gender identity, sexual orientation or preference, marital status, military
<br />status, age over 40 years, genetic information, or the existence of any sensory, mental
<br />or physical handicap in the administration or delivery of programs and services.
<br />Section 2. Program Participation Non - Discrimination. The Council encourages
<br />participation in all its activities, services, and granting programs by individuals of all
<br />cultural, ethnic, geographic, sexual orientation, and religious background and fully
<br />complies with the American with Disabilities Act.
<br />ARTICLE VII
<br />NON - PROFIT STATUS
<br />Section 1 General. The Louisville Cultural Council (LCC) is organized by the
<br />City Council of the City of Louisville, Colorado, to operate as a nonprofit organization for
<br />charitable, educational, cultural, and scientific purposes within the meaning of Section
<br />501(c)(3) of the Internal Revenue Code, as amended from time to time, to promote and
<br />to provide for the production, presentation, exhibition, coordination, advancement, and
<br />preservation of art, music, theater, dance, zoology, botany, or natural history for the City
<br />of Louisville, Colorado, and to promote communication among the several cultural arts
<br />organizations operating within the City of Louisville, Colorado.
<br />Section 2 Contributions. Consistent with these purposes, the Council may
<br />promote, solicit, and encourage contributions from community organizations, both public
<br />and private, including grants from corporations or individuals, of monies, personal and
<br />real property, and other objects or items of value, by donation, dedication, grant, gift,
<br />devise, or otherwise, which contributions might be beneficially devoted to the public use
<br />in the establishment and development of the Council's Articles of Incorporation or these
<br />bylaws. All funds received by the Council shall be deemed entrusted by the People of
