<br />RESOLUTION NO. 40 <br />SERIES 2001 <br /> <br />A RESOLUTION SUBMITTING A BALLOT ISSUE TO A VOTE OF THE <br />REGISTERED ELECTORS OF THE CITY OF LOUISVILLE AT THE <br />COORDINA TED ELECTION TO BE HELD NOVEMBER 6, 2001 <br /> <br />WHEREAS, the City will hold a regular municipal election on November 6, 2001, as a <br />coordinated election pursuant to the Uniform Election Code of 1992, as amended; and <br /> <br />WHEREAS, the City requires revenues, including but not limited to property taxes, in order <br />to provide municipal services to the citizens; and <br /> <br />WHEREAS, the City is authorized to collect, retain and expend certain revenues received by <br />the City only with voter approval; and <br /> <br />WHEREAS, the purpose of the ballot issue set forth in this Resolution is to provide for <br />additional revenues needed by the City by authorizing the City to collect, retain and expend certain <br />property tax revenues; and <br /> <br />WHEREAS, the City Council finds it is in the best interest of the City to refer said ballot <br />issue to a vote of the registered electors of the City at the November 6, 2001, municipal election <br />pursuant to Article X, Section 20 of lthe Colorado Constitution. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. The following ballot issue, certified in substantially the form set forth below, <br />is hereby referred to the registered electors of the City and shall appear on the ballot of the City of <br />Louisville municipal election to be held on November 6,2001: <br /> <br />WITHOUT INCREASING AJ~Y CURRENT TAX RATE OR ADDING ANY NEW <br />TAXES, SHALL THE CITY OF LOUISVILLE, COLORADO ("CITY") BE <br />AUTHORIZED TO COLLECT, RETAIN, ~ EXPEND THE FULL PROCEEDS <br />OF THE CITY'S PROPERTY TAXES COLLECTED AND RECEIVED BY THE <br />CITY DURING THE YEAR 2001 AND EACH SUBSEQUENT YEAR, FOR <br />CAPITAL PROJECTS, MUNICIPAL OPERATIONS AND SERVICES, OR ANY <br />OTHER LEGAL PURPOSES OF THE CITY, NOTWITHST~ING ANY STATE <br />RESTRICTION ON FISCAL YEAR REVENUE AND SPENDING, INCLUDING <br />WITHOUT LIMIT A TION THE RESTRICTIONS OF ARTICLE X, SECTION 20 <br />OF THE COLORADO CONSTITUTION (WHICH IS COMMONLY KNOWN AS <br /> <br />1 <br />
