RESOLUTION NO. 4 SERIES 1997 A RESOLUTION APPROVING A PURCHASE AGREEMENT TO BUY AND SELL REAL ESTATE WHEREAS, the City of Louisville and County of Boulder desire to purchase for open space purposes a parcel of land of 46 acres, more or less, located adjacent to the north boundary of the City of Louisville and the Hillsborough North Subdivision at 8700 Baseline Road, and more particularly described and depicted on Exhibit A, attached hereto (hereinafter "the Property"); and WHEREAS, the City and County have Agreement with Columbine Land Resources, contract to purchase the Property; and negotiated a Inc., which Purchase is under WHEREAS, Columbine Land Resources, Inc. has stated its desire to sell the Property to the City and County upon the terms and conditions described in a mutually-agreeable Purchase Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The proposed Purchase Agreement between the City of Louisville, County of Boulder and Columbine Land Resources, Inc. regarding the Property described and depicted in Exhibit A is hereby approved in essentially the same form as the copy of such Purchase Agreement accompanying this Resolution as Exhibit B. 2. The Mayor is authorized to execute the Purchase Agreement, except that the Mayor is hereby granted the authority to negotiate and approve such revisions to said Purchase Agreement as the Mayor determines are necessary or desirable for the protection of the City, so long as the essential terms and conditions of the Purchase Agreement are not altered. 3. The Mayor, City Administrator and City staff are further authorized to do all things necessary on behalf of the City to perform the obligations of the City under the Purchase Agreement, and to execute and deliver any and all documents necessary to effect the purchase of the Property under the terms and conditions of the Purchase Agreement.
