<br />RESOLUTION NO. 28 <br />SERIES 2007 <br /> <br />A RESOLUTION APPROVING A F'INAL PUD DEVELOPMENT PLAN AND SPECIAL <br />REVIEW USE FOR 932 MAIN STREET (AKA 940 MAIN STREET). <br /> <br />WHEREAS, there has been submitted to the Louisville City Council, a request for approval of a <br />Final PUD Development Plan and Special Review Use for 932 Main Street (aka 940 Main Street) for a <br />multi-story, mixed-use (retail, office and residential) building structure supported by an underground <br />parking structure; and <br /> <br />WHEREAS, all materials related to the final PUD development plan and Special Review Use <br />have been reviewed by City Staff and the Planning Commission and found, to be in compliance with <br />the Louisville zoning ordinances, subdivision regulations, the Downtown Design Handbook and <br />Downtown Framework Plan, related policies and previous approvals; and <br /> <br />WHEREAS, after a duly noticed public hearing concerning said Final PUD development plan <br />and SRU on May 10, 2007, where evidence and testimony were entered into the public record, <br />including the staff report dated May 10, 2007, the Planning Commission recommended approval to the <br />City Council, with the following three conditions; <br />1. The applicant shall submit for landmark status 920 Main Street, formerly Joe's Market, through <br />the Historic Preservation Commission. <br />2. The applicant must provide the City a payment in-lieu fee of $3,600 per each insufficient parking <br />space. Payment should be received prior to issuance of building permit. <br />3. The applicant must reduce the use of glazing by 10% in the courtyard elevation; and <br /> <br />WHEREAS, City Council has reviewed the application, including the recommendation of the <br />Planning Commission and finds that the revised documents are in full compliance with the conditions of <br />the Planning Commission and that the application should be approved, with two conditions: <br /> <br />1. The applicant shall submit for landmark status 920 Main Street, formerly Joe's Market, through <br />the Historic Preservation Commission. <br />2. The applicant must provide the City a payment in-lieu fee of$3,600 per each insufficient parking <br />space. Payment should be received prior to issuance of building permit. <br /> <br /> <br />NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Louisville, Colorado <br /> <br />does hereby approve a request for approval of a Final PUD Development Plan and Special Review Use <br />for 932 Main Street (aka 940 Main Stree:t) for a multi-story, mixed-use (retail, office and residential) <br />buildiI1,g,~tJ11s!ure supported by an underground parking structure. <br />y:.....~~.:..
