RESOLUTION NO. 33 SERIES 2007 A RESOLUTION APPROVING A SPECIAL REVIEW USE TO AUTHORIZE AN AMENDMENT TO THE EXISTING MONTESSORI SCHOOL AT 733 JEFFERSON AVENUE WHEREAS, there has been submitted to the Louisville City Council, a request for approval of a Special Review Use (SRU) to authorize an amendment to the existing Special Review Use for Montessori School at 733 Jefferson Avenue; and WHEREAS, all materials related to the SRU have been reviewed by City Staff and the Planning Commission and found to be in compliance with the Louisville zoning ordinances, related policies and previous approvals; and WHEREAS, after a duly notked public hearing concerning said SRU on June 14,2007, where evidence and testimony were entered into the public record, including the staff report dated June 14, 2007, the Planning Commission recommended approval to the City Council, with the following condition: 1. A total maximum occupancy (at anyone time) of30 students and 5 staff shall be noted on the Amended SRU plan sheet. WHEREAS, City Council has reviewed the application, including the recommendation of the Planning Commission and finds that the revised documents are in full compliance with the conditions of the Planning Commission and that the application should be approved, with two conditions: 1. A total maximum occupancy (at anyone time) of30 students and 5 staff shall be noted on the Amended SRU plan sheet. 2. The SRU approval for school use at 741 Jefferson Avenue is cancelled effective as of the date of commencement of the increased occupancy authorized under this approval for 733 Jefferson Avenue. NOW THEREFORE, BE IT RESOIl., VED, that the City Council of the City of Louisville, Colorado does hereby approve a request for approval of a Special Review Use to authorize an amendment to the existing Montessori School at 733 Jeffe:rson Avenue, subject to the conditions set forth above.
