Planning Commission <br />Meeting Minutes <br />June 9, 2011 <br />Page 7 of 11 <br />Why do this project? The Louisville Charter states the City’s ordinances <br />shall provide for an open space zone district into which shall be placed all <br />land which is located wholly within the City and which has been <br />designated as open space… <br />Currently no open space zone district in the City of Louisville. <br />Three objectives associated with the process: <br />1) Establish the open space zone district <br />a. The designated classification of open space lands are set <br />forth in the Open Space Master Plan approved by City <br />Council. <br />b. Provisions regarding the use and management of open <br />space lands are found in the Open Space Master Plan, <br />Article 15 of the City Charter, and Title 4 of the Louisville <br />Municipal Code. <br />2) Rezone City owned properties to Open Space <br />a. Staff is recommending rezoning three (3) City owned <br />properties as Open Space: Hillside, Davidson Mesa and <br />Damyanovich. <br />b. The process for selection of properties to be included is time <br />consuming as there are often many parcels of land included <br />in a single Open Space property <br />3) Amend Title 4 of the LMC to ensure the classification and <br />management described in the City Charter is enacted in the City <br />Code. <br />a. The City Charter is the guiding legal document for the City of <br />Louisville. <br />b. In instances where the City Charter is in conflict with the <br />LMC, the City Charter takes precedence. <br />c. Staff is proposing amendments to Title 4 of the LMC to <br />ensure that it reflects the Classification and Management of <br />Open Space Land policy outlined in the Charter. <br />d. As this ordinance does not include changes to Title 17, it is <br />not the Planning Commission’s purview to review it. <br />Staff recommends the Planning Commission approve Resolution No. 14, Series <br />2011 a Resolution recommending amendments to Title 17 of the Louisville <br />Municipal Code to create an open space zone district and district regulations, <br />and recommending rezoning certain city-owned parcels to open space without <br />conditions. <br />Commission Questions of Staff: <br />Sheets asked why there was no public notice. <br />McMillan replied this is a legislative re-zoning required by the Louisville Charter, <br />therefore a mailed public notice to individual property owners is not necessary. <br />Staff will confirm with the City Attorney regarding our decision of how we handled <br />the public notice. <br />
