<br />RESOLUTION NO. 14 <br />SERIES 1997 <br /> <br />A RESOLUTION APPROVING <br />A FINAL PUD DEVELOPMENT PLAN FOR <br />NEODATA SERVICES INC. <br />LOT 1, NEODATA SUBDIVISION <br /> <br />WHEREAS, there has been submitted to the Louisville City Council by Neodata Services <br />Inc., a PUD Development Plan for Lot 1, Neodata Subdivision; and <br /> <br />WHEREAS, all materials related to the Pinal PUD Development Plan have been reviewed <br />by City Staff and the Planning Commission and found to be in compliance with the Louisville <br />zoning ordinances, subdivision regulations, and related policies; and <br /> <br />WHEREAS, after a properly advertised public hearing concerning said Pinal PUD <br />Development Plan, the Planning Commission recommended to the City Council approval; and <br /> <br />WHEREAS, the City Council finds that said Pinal PUD Development Plan for Neodata <br />Services Inc. should be approved, with the following condition: <br /> <br />1. Staff and the applicant shall develop a notation to be incorporated on the PUD that would <br />require the City Administrator and the Property Owner (Neodata Subdivision) to resolve <br />complaints from adjoining neighborhoods/property owners with regard to on-site issues of <br />disturbance including, but not limited to lighting levels, noise, and numbers of employees on site <br />after normal working hours. Should the City Administrator and the Property Owner fail to <br />resolve the complaint(s), the issue(s) shall be forwarded to the City Council for remedial action <br />as may be necessary. <br /> <br />2. A note shall be added to the PUD stating: Operations of auxiliary generator shall comply <br />with all state and local noise ordinances, as may be in effect from time to time. <br /> <br />3. The applicant will make every reasonable effort to limit the hours of non-emergency operations <br />for the auxiliary generator to daytime hours. <br /> <br />4. Timing of the parking lot lighting shall be specified on the PUD. <br /> <br />5. Remove dashed line on the architectural site plan denoting "limits of building envelope per <br />approved PUD" . <br />
