BALSER, INTERIM CITY MANAGER <br />JULY 17, 2007 <br /> <br />SUBJECT: APPROVAL OF DEED OF CONSERVATION EASEMENT IN GROSS AND <br />EASEMENT DEED FOI~ CTC FILING NO.2. <br /> <br />ORIGINATING DEPARTMENT: <br /> <br />DEPARTMENT OF PUBLIC WORKS <br /> <br />SUMMARY <br /> <br />In April 2003 the City Council approvHd the Final PUD and PLAT for CTC Filing No.2. The <br />need for additional easements was identified as CTC Filing NO.2 transitioned from the planning <br />phase to the design phase. Specifically, the need for a drainage easement along Lots 6 and 12 <br />for the conveyance of major drainage along with the need for a public utility easement for Lots <br />2, 3, 5 and 16. The property owner suggested using a Conservation Easement for Lots 6 and <br />12 similar to what was approved with the Final PUD and PLAT for Lots 12 through 15. <br /> <br />The Conservation Easement will allow for the construction of an open channel for the <br />conveyance of major drainage. The public utility easements will allow for the placement of wet <br />and dry public utilities.
