<br />ORDINANCE # 519 <br /> <br />AN ORDINANC.E AMENDING CHAPTERS 11, 12, <br />AND 28 OF THE LOUISVILLE MUNICIPAL CODE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />LOUISVILLE, COLORADO. <br /> <br />SECTION 1. Sections 12.1J and 12.14 of the Louisville <br />Municipal Code are hereby repealed. <br /> <br />SECTION 2. The following sections are hereby added to <br />Chapter 12 of the Louisville Municipal Code. <br /> <br />Section 12.1J Garbage, Refuse and Dead Animals. <br /> <br />a) No person shall deposit, or cause to be deposited, any <br />rubbish, trash, manure, ashes, tin cans, garbage, waste matter <br />or debris of any kind in any ditch, canal, or waterway, nor <br />in any street or alley, nor upon any property within the city, <br />whether such property be publicly or privately owned. <br /> <br />b) All garbage orre:fuse, consisting of waste, animal or <br />vegetable matter upon which rats may feed and all small dead <br />animals shall be placed and stored in a covered metal container <br />as prescribed by the code enforcement officer. <br /> <br />Section 12.14 Accumulations of Trash, Garbage, <br />Rubbish, etc. <br /> <br />It shall be unlawful for any person to allow or permit trash,. <br />brush, garbage, rubbish, or building materials to accumulate in <br />any building, or any propelrty, or along any alley or sidewalk. <br /> <br />SECTION J. Sections 28.11 and 28.12 of the Louisville <br />Municipal Code are hereby lrepealed. <br /> <br />SECTION 4. The following sections are hereby added to <br />Chapter 28 of the Louisville Municipal Code: <br /> <br />Section 28.11 Cutting of Weeds. <br /> <br />a) Definitions--Weeds shall mean w~eds, grass, brush, or other <br />vegetation including but nlDt limited to: Bindweed, Canada Thistle, <br />Russian Knapweed, Perennial Sowthistly, Ragweed, Dandelion, Common <br />Sunflower, Sandburs, and natural grasses. <br /> <br />b) Cutting Required--Weeds shall be kept cut to a height <br />not in excess of six (6) inches. It shall be the duty of the owner, <br />agent or occupant of the p:roperty to cut the weeds on said property, <br />to cut the weeds on alleys abutting said property to the middle of <br />the alley, and to cut the weeds on sidewalk areas abutting said <br />prop~rty, including all parking areas. <br /> <br />c) Cutting by City, Owner Liable for Costs--If weeds exist <br />on any property to heights greater than 6 inches, the City <br />Administrator, or his authlorized agent, after notice by mail to <br />the last known address of the owner, agent or occupant of the <br />property, may order the cutting and removal of the weeds by the <br />City. The City shall access the costs therefor, plus an additional <br />amount up to $25.00 to cover administrative costs against the lots <br />or tracts of land from which the weeds are removed. <br /> <br />d) Assessment--In the event the owner, agent, or occupant shall <br />fail within thirty (JO) days after said billing to pay the costs <br />and expenses of weed cutting by the City, a lien shall be assessed <br />against the property for such costs and expenses by the City Clerk. <br />The City Clerk shall certify said assessment to the treasurer of <br />Boulder County who shall e:xtend said assessment upon the tax roll <br />and collect the same in the same manner as other taxes upon said <br />property. <br />
