<br />" <br /> <br />ORDINANCE NO. 541 <br /> <br />AN ORDINANCE A.MENDING AND RJELATING TO ZOIUNG, <br />AMENDING TITLE 17, CHAPTERS 17.08, 17.12, AND <br />17.16, OF THE LOUISVILLE MUN~C~PAL CODE, FOR <br />THE REGULATION AND SEPARATION OF, ADULT THEAT- <br />ERS AND ADULT BOOKSTORES. <br /> <br />WHEREAS, the City Council deems it to be in the best interests <br /> <br />of the citizens of the City of Louisville to regulate the location <br /> <br />of adult theaters and adult bookstores; and <br /> <br />WHEREAS, it has been demonstrated that the establishment of <br /> <br />more than two uses of certain types within 1,000 feet of each other, <br /> <br />has a deleterious effect on the surrounding residential and <br /> <br />business areas and that the festering of such businesses within <br /> <br />close proximity tends to create a "Skid Row" atmosphere; and <br /> <br />WHEREAS, it has been demonstrated that the establishment of <br /> <br />certain businesses in business districts, which are immediately <br /> <br />adjacent to and which serve residential neighborhoods, has a <br /> <br />deleterious effect on both the business and the residential <br /> <br />segments of the neighborhood, causing blight and downgrading of <br /> <br />property value; and <br /> <br />WHEREAS, concern for, and pride in, the orderly planning and <br /> <br />development of a neighborhood should be encouraged and fostered in <br /> <br />those persons comprised of residential and business segments of that <br /> <br />neighborhood; <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> <br />OF LOUISVILLE, COLORADO: <br /> <br />SECTION 1. <br /> <br />Title 17, Chapter 17.05 of the Louisville Municipal <br /> <br />Code dealing with definitions is hereby amended to add the following: <br /> <br />Section 1J-102 Words and Terms <br /> <br />(A) (121) Adult amusement or entertainment. <br /> <br />Amusement or enter- <br /> <br />tainment which is distinguished or characterized by an emphasis on <br /> <br />material depicting, describing or relating to "Specified Sexual <br /> <br />Activities" or "Specified Anatomical Areas" or which features top~ <br /> <br />less dancers, exotic dancers, strippers, male or female inpersonators <br /> <br />or similar entertainment. <br /> <br />(A) (122) Book Store, Adult, <br /> <br />An establishment having as a <br /> <br />substantial or significant portion of its stock in trade, books, <br /> <br />-1- <br />
