COUNCIL COMMUNICATION <br />TO: MAYOR AND CITY COUNCIL <br />FROM: MALCOLM FLEMING, CITY MANAGER <br />DATE: SEPTEMBER 13, 2011 <br />SUBJECT: DISCUSSION — DRAFT IMPACT FEE STUDY <br />ORIGINATING DEPARTMENT: CITY MANAGER'S OFFICE <br />SUMMARY: At the end of 2010, City Council approved a contract with TischlerBise Inc. to <br />update the current Impact Fee and Study completed in December of 2006. The 2006 study and <br />the impact fee ordinance specify that a review should occur every 5 years. The update <br />reviewed the previous study for the Parks and Open Space, Library, Recreation and <br />Transportation impact fees to determine adjustments based on current land use forecasts and <br />future capital facility needs and service levels. The update also included meetings and <br />feedback on the updated study from a Liaison Committee which included the following <br />members: <br />• Annette Anderson, resident representative <br />• John Benedetti, Chamber of Commerce representative <br />• Rick Brew /Justin McClure, local developer <br />• Judy Goodson, Downtown Business Association representative <br />• Rob Lathrop; Business Retention & Development Committee representative <br />• Michael Markel, local home builder /developer; <br />• Michael Menaker, Revitalization Commission representative <br />• Chris Pritchard, Planning Commission representative <br />• Scott Reichenberg, Colorado Tech Center representative <br />• Jeff Sheets, commercial developer <br />The Liaison Committee met February 23 for introductions and background and again on June <br />20 to review the draft study, ask questions, and provide feedback to the Consultant and staff. <br />The initial draft took longer than expected as the City was waiting on traffic data from the <br />Denver Regional Council of Governments (DRCOG). At the June 20 meeting a number of <br />questions were raised and Tishler Bise and staff were directed to follow -up on a few items. <br />Having done so, the Liaison Committee supports the findings of the study and forwarding to <br />City Council for approval. Attached is a power point presentation highlighting the background <br />and work of the study. Chris Cullinan with TischlerBise will be in attendance at the September <br />13 study session to give the presentation.
