COUNCIL COMMUNICATION TO: MAYOR AND CITY COUNCIL FROM: MALCOLM FLEMING, CITY MANAGER DATE: SEPTEMBER 13, 2011 SUBJECT: DISCUSSION — DRAFT IMPACT FEE STUDY ORIGINATING DEPARTMENT: CITY MANAGER'S OFFICE SUMMARY: At the end of 2010, City Council approved a contract with TischlerBise Inc. to update the current Impact Fee and Study completed in December of 2006. The 2006 study and the impact fee ordinance specify that a review should occur every 5 years. The update reviewed the previous study for the Parks and Open Space, Library, Recreation and Transportation impact fees to determine adjustments based on current land use forecasts and future capital facility needs and service levels. The update also included meetings and feedback on the updated study from a Liaison Committee which included the following members: • Annette Anderson, resident representative • John Benedetti, Chamber of Commerce representative • Rick Brew /Justin McClure, local developer • Judy Goodson, Downtown Business Association representative • Rob Lathrop; Business Retention & Development Committee representative • Michael Markel, local home builder /developer; • Michael Menaker, Revitalization Commission representative • Chris Pritchard, Planning Commission representative • Scott Reichenberg, Colorado Tech Center representative • Jeff Sheets, commercial developer The Liaison Committee met February 23 for introductions and background and again on June 20 to review the draft study, ask questions, and provide feedback to the Consultant and staff. The initial draft took longer than expected as the City was waiting on traffic data from the Denver Regional Council of Governments (DRCOG). At the June 20 meeting a number of questions were raised and Tishler Bise and staff were directed to follow -up on a few items. Having done so, the Liaison Committee supports the findings of the study and forwarding to City Council for approval. Attached is a power point presentation highlighting the background and work of the study. Chris Cullinan with TischlerBise will be in attendance at the September 13 study session to give the presentation. The Liaison Committee members have also been invited.
